RESOLUTION NO. 22-3336 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />RECOGNIZING THE DECLARATION OF A WEATHER EMERGENCY <br />ISSUED BY THE GOVERNOR OF THE STATE OF FLORIDA, <br />EFFECTIVE THROUGHOUT THE STATE OF FLORIDA INCLUDING <br />SEMINOLE COUNTY AND THE MUNICIPALITIES SITUATED <br />THEREIN; CONFIRMING THE LOCAL STATE OF EMERGENCY FOR <br />THE CITY OF CASSELBERRY BY THE CITY MANAGER; <br />AUTHORIZING THE EXERCISE OF EMERGENCY MANAGEMENT <br />PROCEDURES IN ORDER TO PROTECT THE HEALTH, SAFETY, AND <br />WELFARE OF THE CITIZENS OF CASSELBERRY, MEMBERS OF THE <br />GENERAL PUBLIC, AND CITY EMPLOYEES; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, the weather system identified as Hurricane Ian by the National <br />Hurricane Center poses a serious potential threat to the residents and property of the <br />City of Casselberry; and <br />WHEREAS, Hurricane Ian has the potential for causing substantial damage to <br />public utilities, public buildings, public communication systems, public streets and roads, <br />public drainage systems, commercial and residential buildings and areas; and <br />WHEREAS, the Honorable Ron DeSantis, Governor of the State of Florida, has <br />entered, on September 24, 2022, the attached Executive Order Number 22-219 <br />establishing a state of emergency as a result of Hurricane Ian, attached as Exhibit A; <br />and <br />WHEREAS, on September 24, 2022, the President of the United States issued a <br />Presidential National Emergency Declaration for the state of Florida; and <br />WHEREAS, the City of Casselberry desires to adequately protect its citizens <br />from the hazards of Hurricane Ian and potential adverse situations and effects; and <br />WHEREAS, the immediate danger to the public health, safety, or welfare <br />requires emergency action; and <br />WHEREAS, Chapter 252, Florida Statutes, and Chapter 30 of the City Code, <br />empower the City Commission to declare a State of Local Emergency when <br />conditions such as those described above are found to exist; and <br />WHEREAS, Chapter 252, Florida Statutes, and Chapter 30 of the City Code, <br />empower the City Manager, as Director of Emergency Management, to exercise <br />extraordinary powers during the existence of a State of Local Emergency, including <br />the exercise of certain powers by emergency regulations issued by the City <br />Manager; and <br />1 <br />
