Grant # P0120 FIRST AMENDMENT TO FUNDING AND PROGRAM AGREEMENT BETWEEN THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY AND THE CITY OF CASSELBERRY THIS FIRST AMENDMENT (First Amendment) TO THE FUNDING AND PROGRAM AGREEMENT (Agreement), by and between the FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY (DEO), located at 107 East Madison Street, Tallahassee, Florida 32399-4120, and the CITY OF CASSELBERRY (Recipient), located at 95 Triplet Lake Drive, Casselberry, Florida 32707, is made and entered into as of the date last signed below (the "Effective Date"). DEO and Recipient are sometimes hereinafter referred to as a "Party" and collectively as the "Parties." RECITALS WHEREAS, on January 6, 2015, DEO and Recipient entered into a Funding and Program Agreement for deliverables described in Exhibit A of the Agreement; and WHEREAS, as a result of delays in processing and finalizing the grant agreement the Recipient is not able to meet the original deliverable due dates in accordance with Exhibits A and B of the Agreement; and WHEREAS, the Parties deem it appropriate to amend the Funding and Program Agreement to modify deliverable due dates resulting from the delays in executing the Agreement. NOW, THEREFORE, in consideration of the promises and mutual agreements contained herein, the Parties agree as follows: 1. The Table in Section 4 of Exhibit A of the Agreement is stricken in its entirety and the following is substituted in its place: Deliverables' Performance Measures and Due Date Financial Consequences Deliverable 1: Public Involvement/ Stakeholder Due date: March As provided in Coordination Report 2, 2015 Section S.C. of this Agreement.
