Mr. Alan Farrar, 522 Queens Mirror Circle, Casselberry, Florida came forward. Mr. Farrar questioned the <br />intensity of the lighting for boat docks. A general discussion ensued regarding the City's lighting requirements and <br />installation of light reflectors on the boat docks. <br />Mr. Hale asked for a motion to address CU 22-06, Ms. Divita made a motion that the Planning and Zoning <br />Commission approve case number CU 22-06 with staff's conditions, based upon the staff report and the testimony <br />and evidence presented, that the request meets the applicable provisions of the City Code of Ordinances (City Code) <br />and the Unified Land Development Regulations (ULDR) and is consistent with the Comprehensive Plan as per the <br />written findings contained within the staff report, the eight (8) conditions of approval and Attachments A - C. Ms. <br />Saporito seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 22.07: 1387 State Road 436. A conditional use request for the sale of beer and <br />wine for on-site consumption (2COP) at Chipotle Mexican Grill located at 1387 SR 436. <br />Ms. Christina Hyson, Chief Planner, reviewed the information provided in her memorandum dated June 8, <br />2022 to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said the proposed hours of operation <br />have been changed to 10:45 a.m. to 11:00 p.m. daily and the proposed hours meet the City Code requirement for <br />alcohol sales. <br />Ms. Hyson said staff recommends that case number CU 22-07 be approved with staffs conditions, based <br />upon the staff report and the testimony and evidence presented, that the request meets the applicable provisions of <br />the Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the written findings <br />contained within the staff report. The conditions of approval are as follows: <br />1. The conditional use shall be limited to the location of 1387 SR 436. <br />2. All sales and consumption of alcoholic beverages, except for approved package sales, shall be on-site <br />and indoors or confined to outdoor seating areas that have been approved as part of the official site <br />plan. <br />3. Package sales of alcoholic beverages for off-site consumption shall be permitted in accordance with the <br />most current local, state, and federal regulations and only as long as the Applicant complies with those <br />same regulations. <br />4. Sale of alcoholic beverages is prohibited when food service is not available. <br />5. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />6. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10- <br />2 of the City of Casselberry's Code of Ordinances. <br />7. The business shall remain in compliance with all City, County, and State requirements. <br />8. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />
