PISTOL RANGE AGREEMENT <br />CITY OF NEW SMYRNA BEACH <br />RECEIVED <br />FEB - 6 2018 <br />POLICE CHIEF'S OFFICE <br />THIS AGREEMENT made and entered into this °qday of 20 between <br />the City of New Smyrna Beach, a municipal corporation of the State of Florida, hereinafter <br />referred to as New Smyrna Beach, and hereinafter <br />referred to as Permittee. <br />WITNESSETH <br />WHEREAS, in order that Permittee and its agents or employees may maintain a level <br />of performance in its use of firearms commensurate with their obligations and <br />responsibilities as law enforcement or military officers, and in consideration of the mutual <br />promises hereinafter contained in this Agreement, this Agreement is entered into to enable <br />Permittee to use the New Smyrna Beach Police Department Pistol Range. <br />NOW, THEREFORE, the parties hereto agree as follows: <br />The above recitations are true and correct. <br />2. New Smyrna Beach hereby agrees to permit the agents or employees of <br />Permittee to use the New Smyrna Beach Police Department Pistol Range at such time(s) as <br />are mutually agreed upon between the parties in accordance with individual departmental <br />schedules. During this period of pistol range use by the agents or employees of Permittee, <br />said agents or employees will be under the control and direction of the New Smyrna Beach <br />Police Department Range Officer in addition to being subject to any and all rules and <br />regulations for the use of the range which may be provided for in the New Smyrna Beach <br />Police Department=s Policies and Procedures or Rules and Regulations, which shall be <br />provided to the Permittee Training Instructor upon request. <br />3. Permittee agrees to provide ammunition for its agents or employees which <br />conforms to any and all specifications set by the New Smyrna Beach Police Department <br />Range Officer and to utilize only weapons which conform to any and all specifications set by <br />said Range Officer, <br />4. Permittee further agrees to provide a qualified instructor/range officer to <br />Page 1 of 3 <br />
