The property has remained vacant since the closure of the <br />previous business, a convenience store with gas pumps, in 2015. The applicant is proposing to demolish <br />the existing structure and redevelop the subject property with an approximately 10,860 square foot free- <br />standing emergency room. However, the current zoning of the subject property, CG (Commercial General) <br />is not consistent with the existing Future Land Use Map (FLUM) designation of Major Thoroughfare <br />Mixed -Use (MTMU). The applicant is requesting an amendment to the Official Zoning Map to rezone the <br />property to PMX-MID (Planned Mixed -Use: Medium Rise) in order to correct the inconsistency so that the <br />site can be redeveloped. The proposed zoning district, PMX-MID, is classified as a Planned Unit <br />Development (PUD) zoning district and must therefore adhere to the requirements of Article XX, Planned <br />Unit Development, of the Unified Land Development Regulations (ULDRs). In addition to following the <br />standard zoning map amendment procedures established in Section 66-58 and Section 1-2.9 of the ULDR, <br />all PUD applications require the submission of a concept plan and the execution of a PUD Agreement as <br />part of the rezoning process. The proposed PUD Agreement is included as Attachment B to Ordinance 22- <br />1570. <br />Notification was provided to the surrounding property owners within 500 feet on June 28, 2022 and written <br />notices for the Official Zoning Map amendment were posted at the subject property on June 29, 2022. The <br />Planning and Zoning Commission, serving as the City's Local Planning Agency (LPA), voted unanimously <br />at its meeting on July 13, 2022 to recommend approval of this item to the City Commission. The request <br />to amend the Official Zoning Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: <br />Medium Rise) for the subject property is consistent with the City's Comprehensive Plan and the Major <br />Thoroughfare Mixed -Use Future Land Use designation; compatible and consistent with the adjacent land <br />uses and zoning districts; and connections for City water and sanitary sewer services are available to the <br />subject property. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended approval of Ordinance 22-1570 on first reading. <br />Audience Participation: No one came forward to address Ordinance 22-1570. <br />MOTION: Commissioner Busch moved to approve Ordinance 22-1570 on first reading, <br />as presented. Motion was seconded by Commissioner Meadows. Motion <br />carried unanimously by voice vote 5-0. <br />11. PUBLIC HEARING <br />A.
