Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />April 13, 2022 <br />Page 3 <br />Mr. Hale asked for a motion to address CU 22-03, Ms. Divita made a motion that the Planning and Zoning <br />Commission approve case number CU 22-03 based upon the staff report and the testimony and evidence presented, <br />that the request meets the applicable provisions of the Unified Land Development Regulations and is consistent with <br />the Comprehensive Plan as per the written findings contained within the staff report, the nine (9) conditions of <br />approval and Attachments A — B. Ms. Saporito seconded the motion. The motion passed unanimously by voice vote. <br />Ms. DeJesus left the meeting at 6:45 p.m. <br />Sixth Item of Business: SPR 21.11: Icon Commons at 380 SR 436. A major site plan request to construct a <br />six -story, ±39,590 sq. ft. mixed-use building, as well as associated hardscape, landscaping, stormwater <br />retention, and site lighting. <br />Mr. Christina Hyson, Chief Planner, reviewed the information provided in her memorandum dated April 13, <br />2022 to the City of Casselberry Planning and Zoning Commission. Ms. Hyson stated that the maximum height for <br />light poles is 20 feet. She said the height is shown correctly on the photometric plan but not on the site plan. <br />Ms. Hyson said staff recommends that the Planning and Zoning Commission approve case number SPR 21- <br />11, based on the staff report and the testimony and evidence presented, that the request meets the applicable <br />provisions of the Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the <br />written findings in the staff report. The conditions of approval are as follows: <br />1. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to <br />the expiration of this approval. <br />2. A tree bank payment of $10,500.00 must be submitted prior to the issuance of a Certificate of <br />Occupancy. <br />3. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />commencement of development. <br />4. All of the above conditions shall be fully and faithfully executed, or the site plan shall become null and <br />void. <br />In response to the Commission's question regarding providing a secondary access to the property for <br />emergency vehicles, Ms. Hyson stated that Seminole County Fire Department reviewed and approved the site plan <br />based on their code requirements. <br />In response to the Commission's question regarding cross access, Ms. Hyson explained that it is difficult to <br />provide cross access for developed properties. <br />
