PARKING AGREEMENT <br />THIS PARKING AGREEMENT is by and between SOUTH SEMINOLE LODGE NO. <br />364 FREE AND ACCEPTED MASONS OF FLORIDA, hereinafter referred to as "Masons", <br />whose mailing address is Post Office Box 180364, Casselberry, Florida 32718-0364, and THE <br />CITY OF CASSELBERRY, a Florida municipal corporation, hereinafter referred to as "City", <br />whose address is 95 Triplet Lake Drive, Casselberry, Florida 32707. This Parking Agreement is <br />sometimes hereinafter referred to as the ("Agreement"). <br />WITNESSETH: <br />WHEREAS, the City has jurisdiction over certain public property located within the <br />incorporated limits of the City described in Exhibit "A" and referred to as "Parcel I"; and <br />WHEREAS, the Masons have jurisdiction over certain private property located within the <br />incorporated limits of the City described in Exhibit "A" and referred to as "Parcel 2"; and <br />WHEREAS, Parcel 1 is held by the City for the benefit and general use of the public for <br />functions including, but not limited to, vehicular and pedestrian travel and land access; and <br />WHEREAS, Parcel 2 is held by the Masons for the benefit and general use of their <br />organization for functions including, but not limited to, vehicular and pedestrian travel and use; and <br />WHEREAS, it is City's and Masons' policy to preserve the utility of public or private <br />property for the above stated purposes; and <br />WHEREAS, written authorization and lawful authority is required for any private use of <br />public lands or public use of private lands; and <br />WHEREAS, the Masons have requested authorization from the City to utilize Parcel 1 for <br />parking for the benefit of the Masons and the general public and reciprocally the City has requested <br />authorization from the Masons to utilize Parcel l for the benefit of the City and the general public. <br />NOW THEREFORE, in consideration of the granting of the mutual promises, covenants, and <br />benefits contained herein, and other good and valuable consideration, the receipt and sufficiency of <br />which is hereby acknowledged, the parties agree as follows: <br />1. RECITALS. The above recitals are true and correct and form a material part of this <br />Agreement upon which the parties have relied. <br />
