• Contractor shall be familiar with all laws, ordinances, rules, and regulations that may in any way <br />affect the work. Ignorance on the part of the Contractor will in no way relieve him/her from <br />responsibility. <br />• Contractor shall have inappropriate decals on tow trucks removed. City reserves the right to <br />determine what is inappropriate. <br />• To ensure the safe transport of individuals towed, the tow company will conduct the following <br />background of all tow truck drivers: <br />a. Annual drug testing at a facility approved by the City. <br />b. Submit copy of valid FL drivers' license to the City for an annual driving history <br />review. <br />• FDLE criminal history (FDLE website). The report will be submitted to the City for approval. <br />The City will consider the totality of the circumstances with emphasis on any felony convictions <br />or convictions of moral turpitude including drugs, domestic violence, weapons offenses and <br />sexual offenses. <br />REPRESENTATION AND WARRANTIES OF CONTRACTOR <br />The Contractor represents and warrants to the City: <br />• That they have been in the business of Towing Services within Central Florida for a minimum of <br />five (5) years. <br />• That they have sufficient equipment to perform this contract. <br />• That they have a sufficient number of employees to effectively and efficiently maintain this <br />contract. <br />• That they have the financial resources to perform this contract. <br />MANNER OF PERFORMANCE <br />• The Contractor shall perform all its obligations and functions under this Agreement in accordance <br />with all terms, conditions, and specifications laid forth by the City. <br />• The Contractor shall instruct its personnel that no gratuities shall be solicited or accepted for any <br />reason whatsoever. <br />• The Contractor shall be responsible that any articles found by its employees are turned over to the <br />City's Police Department. <br />• The Contractor will abide by all State and Federal Regulations on wages and hours of an <br />employee. <br />• The Contractor shall be responsible for all its employees and their actions during the term of this <br />contract with the City of Casselberry. <br />• The Contractor shall keep current all licenses and permits whether Municipal, County, State, or <br />Federal required for the performance of its obligations and functions hereunder and shall pay <br />promptly when all fees become due. <br />• If the Contractor does not respond in a timely manner and the City had to make other <br />arrangements, the Contractor will be held responsible for all costs incurred by the City of <br />Casselberry and shall upon demand reimburse the City. <br />• The Contractor must carry identification at all times. <br />21 <br />
