RESERVED RIGHTS OF CITY OF CASSELBERRY <br />City of Casselberry reserves the right to accept or reject any or all proposals, to waive any <br />irregularities and technicalities and may, at its sole discretion, request a clarification or other <br />information to evaluate any or all proposals. City of Casselberry reserves the right to reject any <br />and/or all items proposed or award to multiple Proposals. Prior to approval City of Casselberry <br />may cancel the RFP or portions thereof, without penalty. City of Casselberry reserves the right, <br />before awarding the contract, to require Contractor(s) to submit evidence of qualifications or any <br />other information City of Casselberry may deem necessary. City of Casselberry reserves the <br />right to further negotiate any proposal, including price, with the highest rated Contractor. If an <br />agreement cannot be reached with the highest rated Contractor, City of Casselberry reserves <br />the right to negotiate and recommend award to the next highest Contractor or subsequent <br />Contractor until an agreement is reached. The City of Casselberry, at its sole judgment, will <br />award or reject any or all proposals as is in the best interest of City of Casselberry and the <br />decision shall be final. Contractor warrants that prices, terms and conditions quoted on this bid will be <br />Contractor for acceptance for a period of ninety (90) days from date of bid opening. <br />PROPRIETARY INFORMATION <br />Public Records — Upon award recommendation or ten (10) days after opening, bids become public <br />records and shall be subject to public disclosure consistent with Chapter 119, Florida State Statutes. In <br />accordance with Chapter 119 of the Florida Statutes (Public Records Law) and except as may be provided <br />by other applicable State and Federal Law, all Contractors should be aware that Request for Qualification <br />and the responses thereto are in the public domain. However, the Contractors are requested to identify, <br />specifically any information contained in their proposals which they consider confidential and/or <br />proprietary and which they believe to be exempt from disclosure, citing specifically the applicable <br />exempting law. <br />All proposals received from Contractors in response to this RFP will become the property of the City of <br />Casselberry and will not be returned to the Contractors. In the event of contract award, all documentation <br />produced as part of the process will become the exclusive property of the City. <br />COMPLAINTS AND DISPUTES <br />All complaints will be forwarded to the Chief of Police or his designee. If the incident requires formal <br />investigation, the Contractor will be notified of the complaint by certified mail. The Contractor will have <br />seven (7) business days to reply to the complaint in writing. After the investigation is completed, a memo <br />will be forwarded to the Chief of Police regarding the outcome. If the complaint is sustained, a <br />recommendation of disciplinary action against the Contractor will be forwarded to the Chief of Police. At <br />his discretion, the Chief of Police may reprimand the Contractor in writing or suspend the Contractor for <br />up to 96 hours during their towing month(s). The Chief of Police will report directly to the City Manager <br />for suspensions of more than 96 hours, or for the removal of Contractors from the towing rotation. The <br />Contractor agrees that any complaints received by the City of Casselberry concerning misconduct on the <br />part of the Contractor, such as excessive charges, poor business practices, damage to vehicles, etc., that <br />cannot be resolved between the Contractor and the vehicle owner, will be referred to the Police Chiefs <br />office for appropriate action. If the complaint is not resolved to the satisfaction of the Police Chief or the <br />owner of the vehicle, it may be referred to the City Manager's office. <br />NO DISCRIMINATION <br />Contractor agrees to make no discrimination because of race, color, creed, or natural origin, with respect <br />to employment of personnel on this project, and that all persons having the experience and skill necessary <br />to perform the work shall be afforded equal opportunity of employment for the work to be performed for <br />this service. <br />14 <br />
