In submitting a bid to the City of Casselberry, the Contractor offers and agrees that if the bid/proposal is <br />acceptable, the Contractor will convey, sell, assign or transfer to the City of Casselberry all rights, title <br />and interest in and to all causes of action it may now or hereafter acquire under the antitrust laws of the <br />United States and the State of Florida for price fixing relating to the particular commodities or services <br />purchased or acquired by the City of Casselberry. At the City of Casselberry's discretion, such <br />assignment shall be made and become effective at the time the purchasing agency tenders final payment <br />to Contractor. <br />CERTIFICATE OF INSURANCE <br />The successful Contractor and any subcontractors of the Contractor shall require their insurance carriers, <br />with respect to all insurance policies, to waive all rights of subrogation against the City. The successful <br />Contractor shall submit certificates or other documentation evidence to the City with the signed <br />agreement, attesting to insurance coverage for Worker's Compensation Insurance as required by the <br />Florida Statutes, Public Liability, Property Damage Insurance, Professional Liability Insurance, and other <br />requirements, as stated below: <br />The City of Casselberry shall be named as an ADDITIONAL NAMED INSURED on all certificates and <br />policies pertaining to this project. Insurance companies must be licensed to do business in the State of <br />Florida with a Best's Key Rating Guide rate of no less than A. This information will be verified in the <br />City's discretion, and it may be grounds for disqualification if the information is not in order. <br />Insurance requirements: Upon award the successful Contractor(s) shall be required to obtain and <br />furnish to the City of Casselberry, prior to the contract being effective and maintained during the life of <br />the contract, Certificates of Insurance approved by the City with the following minimum coverage. <br />A. Workers Compensation shall be maintained by the selected Contractor or individual for all <br />employees engaged in the work under the Bid, RFQ or RFP in accordance with the Laws of the <br />State of Florida. Employers Liability Insurance shall be maintained by the selected Contractor or <br />individual at limits no less than the following. <br />$100,000 Each Accident <br />$100,000 Disease Each Employee <br />$500,000 Disease Aggregate <br />B. Comprehensive General Liability Insurance shall be maintained by the selected <br />Contractor or individual with limits not less than the following: <br />$1,000,000 Bodily Injury & Property Damage -each occurrence <br />$1,000,000 Personal & Advertising Injury -each Occurrence <br />$2,000,000 General Aggregate <br />$2,000,000 Products/Completed Operations Aggregated limit <br />$ 5,000 Medical Payment <br />$ 100,000 Fire Damage Legal Liability <br />Coverage shall include Contractual Liability, Independent Contractors Liability, and Garage <br />Keepers including on Hook and Cargo. <br />C. Automobile Liability Insurance shall be maintained by the selected Contractor or individual with <br />a combined single limit of not less than $1,000,000.00 Bodily Injury and Property Damage in <br />accordance with the Laws of the State of Florida, as to the Ownership, maintenance, and use of <br />all owned, non -owned, leased or hired Vehicles. <br />
