RESOLUTION 10-2121 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A LETTER OF UNDERSTANDING BETWEEN <br />SEMINOLE COUNTY AND THE CITY OF CASSELBERRY FOR AMBIENT <br />ENVIRONMENTAL MONITORING RELATED TO THE LAKE JESUP <br />BASIN MANAGEMENT ACTION PLAN; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, in 2007, the City of Casselberry entered into an Interlocal Agreement for Total <br />Maximum Daily Load (TMDL) Activities with Seminole County and other cities in Seminole County which <br />allows for the efficient coordination of projects and activities among the jurisdictions to reach TMDL-related <br />goals; and <br />WHEREAS, one such activity is the Lake Jesup Basin Management Action Plan (BMAP) for <br />monitoring and providing valuable information regarding the water quality in Lake Jesup; and <br />WHEREAS, to monitor the City's actual pollutant load contribution into Lake Jesup, Seminole <br />County has proposed to provide the City with ambient water quality monitoring services monthly at the Gee <br />Creek Weir and annually at Lake Howell through September 30, 2014; and <br />WHEREAS, City staff have reviewed the proposed Letter of Understanding with Seminole County <br />and find it adequate to meet the BMAP monitoring requirements of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Letter of <br />Understanding between Seminole County and the City of Casselberry for Ambient Environmental <br />Monitoring (attached as "Exhibit A") in an annual amount not to exceed $5,278.50, and authorizes the <br />Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Resolution. <br />SECTION IV. Effective Date.
