SETTLEMENT AGREEMENT <br />THIS SETTLEMENT AGREEMENT (hereinafter "Agreement") made by and between <br />JOHN CASSELBERRY and/or assigns (hereinafter "CASSELBERRY") and the CITY OF <br />CASSELBERRY, a Florida municipal corporation (hereinafter "CITY'). Both CASSELBERRY and <br />CITY shall collectively be known as the "Parties." <br />WITNESSETH: <br />WHEREAS, the CITY has filed a Complaint for Foreclosure against John Casselberry and <br />other parties in the Eighteenth Judicial Circuit in and for Seminole County, Florida, entitled City of <br />Casselber7y v. John Casselberry, et al., Case No. 2009 -CA -1806-14-L (hereinafter referred to as <br />"Lawsuit") for foreclosure of Municipal Code Enforcement liens; and <br />WHEREAS, the lawsuit included two counts. Count I is related to property located at 535 <br />Queens Mirror Circle, Casselberry, Florida (hereinafter "Queens Mirror") and Count II was related to <br />property located at 1140 Lancelot Way, Casselberry, Florida (hereinafter "Lancelot"); <br />WHEREAS, CASSSELBERRY previously entered into a settlement agreement with the <br />CITY related to Count II and said Count II was voluntarily dismissed by the CITY on August 11, <br />2009; <br />WHEREAS, CASSELBERRY has indicated to the CITY that he will desires to settle Count <br />I of the lawsuit related to Queens Mirror. <br />NOW, THEREFORE, for and in consideration of the promises contained herein and other <br />good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the <br />parties agree as follows: <br />
