RESOLUTION 10-2108 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF A SETTLEMENT AGREEMENT <br />BETWEEN JOHN CASSELBERRY AND THE CITY OF CASSELBERRY, <br />REGARDING THE FORECLOSURE OF A CODE ENFORCEMENT LIEN ON 535 <br />QUEENS MIRROR CIRCLE; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry filed a foreclosure action entitled City of Casselberry v. <br />John Casselberry, Case No. 2009 -CA -1806-14-L, pertaining to code enforcement liens against John <br />Casselberry relating to his two properties with an address of 535 Queens Mirror Circle, and 1140 Lancelot <br />Way; and <br />WHEREAS, the City of Casselberry and John Casselberry entered into a Settlement Agreement <br />as to the 1140 Lancelot Way property, as reflected in Resolution 09-2051; and <br />WHEREAS, the City of Casselberry wishes to resolve Count I of the Complaint as it pertains to a <br />code enforcement lien against John Casselberry on the property known as 535 Queens Mirror Circle so <br />that the foreclosure action can be dismissed; and <br />WHEREAS, John Casselberry and the City of Casselberry have come to a mutually agreeable <br />resolution to the foreclosure action as it pertains to 535 Queens Mirror Circle; and <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby authorizes the Mayor to <br />execute the Settlement Agreement attached hereto as Exhibit "A," as it pertains to the 535 Queens Mirror <br />Circle code enforcement lien. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />PASSED and ADOPTED this day of TC , AD, 2010. <br />ATTEST: <br />a <br />Donna G.
