Mr. Mark Gisclar <br />Page 7 <br />February 11, 2009 <br />Assumptions: <br />• No written reports will be submitted. <br />• Activities will be for one (1) Construction Inspector for eight (8) hours a day for <br />five (5) days a week for eight (8) months and for administrative support for <br />project documentation. <br />Project Schedule & Fee <br />The anticipated schedule for this project is eight (8) months. An estimated fee for this <br />project is attached. <br />FEE <br />The work associated with Tasks 1 through 4 will be completed based on an hourly not to <br />exceed fee of One hundred and one thousand nine hundred sixty two dollars and <br />eight cents ($101,962.08). Any additional work or meetings will be billed on an hourly <br />basis, plus reimbursable expenses, according to the attached hourly rate schedule. <br />Reimbursable expenses including travel, subsistence, and out-of-pocket expenses, <br />multiplied by 1.15, will be charged to the Client. Standard rates for in-house expenses <br />areas follows: mileage to be charged at the published IRS rate (currently at $0.55 per <br />mile), $0.18 per 8.5" x 11" black and white copy, $1.00 per copy for color and 11" x 17", <br />$1.00 per square foot for larger copies, and $1.00 per facsimile page. <br />TERMS OF AGREEMENT <br />During the course of work if the Client finds it necessary to terminate the work, the work <br />will be stopped by .the Consultant upon receipt of written notification. The Client will <br />pay for services and expenses incurred to the point of termination based upon the <br />Consultant's estimate of percentage of work completed. <br />Invoices for work completed will be submitted every four (4) weeks and are payable <br />upon receipt. In the event that an invoice is not paid within thirty (30) days, the <br />Consultant reserves the right to stop work, after notifying the Client in writing, until such <br />outstanding invoices are paid in full. <br />For work done on an hourly basis, the Consultant reserves the right to increase its hourly <br />rates on an annual basis on January 1 of each year. <br />Under no circumstances will this contract be reassigned without Consultant approval. <br />Reassignment without approval will result in this contract being null and void. <br />Should it become necessary for the Consultant to utilize its attorney to collect fees due <br />the Consultant under this agreement, the Client agrees to bear the costs of collection, <br />including reasonable attorney fees. <br />HDR Engineering, Inc. 1315ERobinson Street I Phone: (407) 420-4200 <br />Suite 400 Fax: (407( 420-4242 <br />Orlando, FL 32801-1949 www.hdrinc.com <br />
