CASSELBERRY CITY COMMISSION <br />Minutes of July 25, 2022 — Regular Meeting <br />Page 18 of 20 <br />The City Commission agreed by consensus to direct staff to move forward with the proposed ordinances as <br />expeditiously as was procedurally possible. Mr. Newlon advised that staff would be directed to bring the <br />proposed changes to the Planning and Zoning Commission at its regularly scheduled meeting in August, <br />and if approved, the proposed ordinances would then be brought to the City Commission for consideration <br />for first and second reading at the appropriate regular City Commission meetings. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The City Manager and the Community Development Director recommended that the <br />City Commission direct staff to bring the proposed ordinances forward to the Planning and Zoning <br />Commission and City Commission for adoption. <br />Audience Participation: The following individuals came forward to address this item: <br />Ed Williams of Williams Development Services, 29 E. Pine Street, Orlando, stated that he was <br />present with representatives of Kitson & Partners, the property management company for the <br />owners of the site where a BJ's Wholesale is proposed to be located, and with representatives of <br />BJ's. He shared some of the challenges that had been encountered with development of the site <br />and expressed concerns about whether the timeline for full review, consideration and adoption of <br />the ordinances would allow for the project to meet its deadlines. He requested that the site plan <br />which included only parking, landscaping, drainage, and utilities be reviewed in advance of the <br />actual adoption of the proposed changes, if at all possible. <br />Doug Markovich, one of the owners of Casselberry Liquor, 130 SR 436, located in the plaza being <br />proposed for development of BJ's, stated he was in favor of rezoning and redeveloping the plaza <br />as he felt it was good for Casselberry to start growing and evolving with the times; however, he felt <br />that prior to any changes which would allow this type of development, the City should do a study <br />on how it would affect small businesses in the community, as he had concerns about the City's <br />smaller businesses being forced out in favor of bigger businesses. <br />No one else came forward to address this item. <br />Discussion: Additional discussion occurred amongst the Commission, after which Mr. Newlon stated he <br />would defer the matter to staff to submit the ordinances through the proper approval processes with the <br />Planning and Zoning Commission and the City Commission. He noted that he understood the urgency of <br />the potential applicant; however, felt it would be inappropriate to accept any plans for review prior to the <br />ordinances having gone through the appropriate legislative approval process. He added that staff would <br />look into whether there was any way the plans could be reviewed prior to full adoption of the ordinances <br />while still adhering to the normal legislative process which could not be changed. He asked Mr. Williams <br />to send him his proposal for what he wanted to have reviewed at this point to see if his request could be <br />accommodated but stressed that nothing could be approved until the new ordinances were adopted on <br />second reading, should that be what ultimately occurs. <br />
