City Commission Meeting <br />August 27, 2007 <br />Page 4 <br />DECISION APPEALS; PROVIDING FOR ENFORCEMENT OFFICIALS; PROVIDING <br />FOR FEES; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERABILITY, <br />CODIFICATION, CONFLICTS AND EFFECTIVE DATE." <br />Staff Presentation: Ordinance 07-1220 revises Article V1, Water Conservation, of City Code <br />Chapter 86, Utilities. The revisions include the following modifications: <br />• The deletion of outdated language in accordance with current St. Johns Water <br />Management District requirements and regulations; <br />• Changing the title of Article VI to Water Conservation and Landscape Irrigation; <br />• Creation of a Division I entitled Water Conservation Generally; <br />• Revisions to provide for the equitable allocation of water resources among all <br />customers; <br />• Addition of Division 2, Landscape Irrigation, to update and revise the Code to comply <br />with and implement new District regulations addressing water conservation and <br />irrigation practices; Landscape irrigation at odd numbered addresses are Wednesday and <br />Saturdays between 10:00 a.m. and 4:00 p.m.; Even numbered addressed on Thursdays <br />and Sundays between 10:00 a.m. and 4:00 p.m. <br />• Modifying enforcement language to provide for the City Manager to designate <br />enforcement responsibility to such personnel and departments of the City as deer <br />appropriate; <br />• Providing for revised_ monetary fees and penalties for violations, and irrigation service <br />disconnection for more than three violations, and non-payment of penalties. <br />The Public Works Director noted the following corrections: "Corrections bolded in Italics" <br />• Page 4, Section 86-334(3), Line 2 changed to "....a written variance has been previously <br />granted or is granted by the City under Section 86-336 of this ordinance, or the property <br />is otherwise excepted pursuant to Section 86-335." <br />Staff Recommendation: Approval of Ordinance 07-1220 on first reading and schedule the <br />second reading and public hearing for September 24, 2007. <br />Audience Input: <br />1) Craig Tull, 420 Ranch Trail, Casselberry, Florida, stated that the ordinance did not <br />delineate between irrigating with reclaimed or potable water. Mr. Torres stated that the <br />same criteria applies to reclaimed, potable water and surface wells <br />MOTION: Moved by Vice Mayor/Commissioner Susan Doerner to approve <br />Ordinance 07-1220, Water Conservations Revisions, as corrected. <br />Motion was seconded by Commissioner Sandra T. Solomon and <br />carried unanimously on a 5 - 0 voice vote. <br />
