behalf of Casselberry, at an hourly rate equal to the full costs of Building Official's salary <br />and benefits as remunerated to him or incurred by Altamonte Springs. The hourly rate <br />equal to the full costs of Building Official's salary and benefits as remunerated to him by <br />Altamonte Springs, as of the effective date of the initial term of this Agreement is $71.96 <br />per hour (hereinafter "hourly rate"). The hourly rate shall increase annually on October <br />1" of each year, based on the CPI adjustment as specified by the U.S. Department of <br />Labor, Bureau of Labor Statistics (ftp://ftp.bls.gov/pub/special.requests/cpi/cpiai.txt). <br />Casselberry shall remit said amounts as billed by Altamonte Springs. <br />3. Delegation of Duties Due to Unavailability: The Building Official may delegate <br />his Casselberry Building Code Administrator duties to another Altamonte Springs <br />employee who is licensed and competent to act as the Casselberry Building Code <br />Administrator when Building Official is unavailable. Both the designated individual and <br />Altamonte Springs shall have the same powers, duties and protections as Building <br />Official and Altamonte Springs are afforded under the terms and conditions of this <br />Agreement. The hourly rate of $71.96 shall also apply to these services effective October <br />1, 2008. This hourly rate shall also increase annually on October I" of each year, based <br />on the CPI adjustment as specified by the U.S. Department of Labor, Bureau of Labor <br />Statistics (ftp://ftp.bls.gov/pub/special.requests/cpi/cpiai.txt). Any such Altamonte <br />Springs employee performing duties for Casselberry under this paragraph shall be subject <br />to Paragraph 1. above, regarding employment status with Casselberry, and shall receive <br />no salary, remuneration, pension or benefits of any kind from Casselberry but shall be <br />reimbursed for all out of pocket expenses incurred on behalf of Casselberry, in <br />accordance with Casselberry Personnel Policies. <br />4. Inspections and Plans Reviews: The Building Code Administrator and/or City of <br />Casselberry may request that Altamonte Springs conduct building and/or fire prevention <br />inspections and plans review services on an as -needed basis. The City of Altamonte <br />Springs agrees to conduct these services subject to availability of personnel. The hourly <br />rate in effect at the time the services are provided shall apply to these services. <br />5. Billings and Collections: Altamonte Springs shall submit invoices on or about a <br />monthly basis for any and all services rendered under this Agreement detailing the <br />services rendered and permit(s) against which such charges are assessed. Casselberry <br />shall' promptly render payment on such submitted invoices. <br />6. Indemnification and Hold Harmless: To the fullest extent permitted by law, <br />Casselberry shall indemnify and save harmless Building Official, Altamonte Springs, its <br />officers, agents and employees, from and against all suits, judgments, claims, damages, <br />losses and expenses, including reasonable attorney's fees and costs and reasonable <br />attorney's fees and costs on appeal, arising out of or resulting from performance under <br />this Agreement, including any complaints filed with the Department of Business and <br />Professional Regulation. Neither party, its officers, agents or employees shall be deemed <br />to assume any liability for the gross negligence or willful or wanton misconduct of the <br />other party. Nothing herein shall be deemed a waiver of Casselberry's sovereign <br />immunity. <br />2 <br />
