CASSCLBERRY CITY COMMISSION <br />Minutes of Marcli 26, 2012 — Regular Meeting <br />Page 5 of 16 <br />ADDITIONAL CRITERIA RELATED TO PERMANENT PLAY STRUCTURES, POOL <br />MAINTENANCE, CARPORT USE AND OUTDOOR/OPEN AIR STORAGE; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Second Reading of Ordinance 12-1370 <br />was published in the Orlando Sentinel on March 15, 2012. <br />Staff Presentation: Ms. Sandra Smith, Development Services Manager, gave a brief overview of the <br />ordinance to the Commission. She advised that the Planning and Zoning Commission made a favorable <br />recommendation (4-1) to the City Commission for adoption of the ordinance at their December 14, 2011 <br />meeting. She noted that the Commission had approved the ordinance on first reading with a request that staff <br />amend the time for placement of trash in the right-of-way for collection. She stated that the revised ordinance <br />is what is before the Commission for adoption on second reading tonight. <br />Ms. Smith further explained that essentially what the ordinance is doing is separating nuisances from property <br />maintenance by reorganizing and consolidating the Code sections and clarifying definitions to make it more <br />understandable, especially for Code Compliance personnel. City Attorney Reischmann reiterated that all of <br />this is basically already in the Code and there isn't a lot of new regulation. <br />In response to questions from the Commission, Ms. Smith confirmed that these Codes are consistent with the <br />surrounding communities. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />adoption of Ordinance 12-1370, <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 12-1370 to hear and consider <br />comments and questions regarding this issue. The following individuals came forward: <br />1. Ms. Rhonda Ovist, 220 S. Embrey Drive, spoke in opposition to Ordinance 12-1370 and <br />presented a petition requesting that the Commission table the ordinance for a year to allow the <br />residents to learn more about how this will affect them and the City. <br />2. Ms. Judith Maribaldi, 137 Northshore Circle, spoke in support of Ordinance 12-1370, stating <br />that the more appealing the area becomes, the more it will attract a better and more diverse <br />class of business, commerce and neighborhoods. <br />3. Ms. Kathy Janney, 133 Northshore Circle, spoke in support of Ordinance 12-1370, stating <br />that she has lived in Casselberry since 1986 and the city has come a long way since then and <br />she supports continuing improvements. <br />4. Mr. John Casselberry, 700 S. Lost Lake Lane, spoke in opposition to Ordinance 12-1370 and <br />expressed concerns about possible hardships to the residents. <br />5. Mr. Ray Dillman, 1520 Avalon Boulevard, stated he has been a resident of the City for 38 <br />years, and voiced concerns about the City's code enforcement process. <br />
