CASSELBERRY CITY COMMISSION <br />Minutes of March 28, 2022 — Regular Meeting <br />Page 10 of 14 <br />1.1. PUBLIC HEARING <br />A. Second Reading of Ordinance 22-1563 — Adding a Property Rights Element into <br />the City's Comprehensive Plan (LPA 21-01 ) <br />The City Clerk read Ordinance 22-1563 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN BY ADDING A PROPERTY RIGHTS ELEMENT IN <br />ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second and final reading of Ordinance <br />22-1563 was advertised in the Orlando Sentinel on Thursday, March 17, 2022. <br />Staff Presentation: Chief Planner Christina Hyson stated that Ordinance 22-1563 amends the City's <br />Comprehensive Plan to add Section 11 Property Rights Element in accordance with Florida Statutes. <br />Section 163.3167 of the Florida Statues requires the City to maintain a comprehensive plan to guide its <br />future growth and development. Section 163.3177 outlines the required elements that must be included in <br />every comprehensive plan. In 2021 the Florida Legislature and Governor approved an amendment to <br />Section 163.3177 of the Florida Statutes to require that each local government shall include in its <br />comprehensive plan a private property rights element to ensure that private property rights are considered <br />in local decision making. The proposed Property Rights Element was developed in accordance with the <br />requirements outlined in Florida Statute 163.3177(6)(i) and is being presented for City Commission <br />approval. The Planning and Zoning Commission, serving as the City's Local Planning Agency (LPA), <br />voted Unanimously 5-0 to recommend approval of this itern to the City Commission at its meeting on <br />October 13, 2021. Following City Commission approval on first reading of Ordinance 22-1563 at the <br />January 24, 2022 regular City Commission meeting, the proposed amendment packet was transmitted to <br />the Department of Economic Opportunity (DEO) and six (6) other agencies on February 4, 2022. A letter <br />was issued to the City on March 4, 2022 stating that the DEO had no comments on the proposed amendment, <br />nor were there any comments from any of the other reviewing agencies; therefore, no changes were made <br />to Ordinance 22-1563 since its approval on first reading. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 22-1563 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 22-1563. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 22-1563. Mayor Henson closed the public hearing relative to <br />Ordinance 22-1563. <br />MOTION: Commissioner Busch moved to adopt Ordinance 22-1563 on second and final <br />reading, as presented. Motion was seconded by Vice Mayor Aramendia. <br />Motion carried unanimously by voice vote 4-0. <br />
