Officer Andreone gave testimony that the property was reinspected and found to remain in violation on <br />February 14, 2022. The City requested a correction date of March 19, 2022. If no compliance by March <br />19, 2022 then a fine of $100.00 per day should then be imposed for each day of non-compliance <br />thereafter. The City requests a subsequent hearing date of April 21, 2022 to determine compliance. The <br />Special Magistrate asked if there was anyone present to speak to this case. There was no one present. <br />The Special Magistrate made a finding that CE -21-001068, located at 1437 Lake Shore Dr., was in <br />violation of the City Code Sections as listed on the notice of code violation, based on testimony and <br />evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the <br />violations by 1:00 P.M. March 19, 2022. If there is no compliance by March 19, 2022, then a fine of <br />$100.00 per day will be imposed for each day the property remains in non-compliance. A subsequent <br />hearing will be held on April 21, 2022 to determine if compliance has been achieved. <br />SUBSEQUENT CASE -NOT IN COMPLIANCE <br />CE -21-000309 715 Benedict Way <br />City Code 1-4.3.a, No building permit <br />Officer Acevedo advised that case 21-000309 located at 715 Benedict Way, was not in compliance by the <br />date set by the Magistrate and fines should be imposed. <br />The Special Magistrate advised that in addition to Officer Acevedo's testimony, she also had affidavit of <br />non-compliance from Officer McDonald, indicating the property was not in compliance. Based upon <br />testimony and the affidavit, it was found that the property located at 715 Benedict Way was not in <br />compliance and fines should be imposed. <br />CE -21-000747 1036 Osceola Trl. <br />0 City Code 1-4.3 No building permit <br />Officer Acevedo advised that case 21-000747 located at 1036 Osceola Trl., was not in compliance by the <br />date set by the Magistrate and fines should be imposed. Officer McDonald advised that he spoke with the <br />daughter of the property owner and their intention is to sell the property. They are aware that fines will <br />start. <br />The Special Magistrate advised that in addition to Officer Acevedo's testimony, she also had affidavit of <br />non-compliance from Officer McDonald, indicating the property was not in compliance. Based upon <br />testimony and the affidavit, it was found that the property located at 1036 Osceola Trl. was not in <br />compliance and fines should be imposed. <br />CE -21-001012 913 Turtle Mound Dr. <br />a City Code 86-162 A, Connection with public system <br />Officer Acevedo advised that case 21-001012 located at 913 Turtle Mound Dr., was not in compliance by <br />the date set by the Magistrate and fines should be imposed. <br />The Special Magistrate advised that in addition to Officer Acevedo's testimony, she also had affidavit of <br />non-compliance from Officer McDonald, indicating the property was not in compliance.
