Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />October 13, 2021 <br />Page 2 <br />that case number CU 21-18 be approved with staff's conditions, based upon the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations <br />and is consistent with the Comprehensive Plan as per the written findings contained within the staff report. He said <br />the conditions of approval are as follows: <br />1. The conditional use shall be limited to the location of 870 State Road 436. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors or confined to outdoor <br />seating areas that have been approved as part of the official site plan. <br />3. Package sales of alcoholic beverages for off-site consumption shall be permitted in accordance with the <br />most current local, state, and federal regulations and only as long as the applicant complies with those <br />same regulations. <br />4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10- <br />2 of the City of Casselberry's Code of Ordinances. <br />6. The business shall remain in compliance with all City, County, and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />8. The conditional use shall commence within 180 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />After a brief discussion regarding the parking deficiency, Mr. Phillips asked the applicant to come forward. <br />Mr. Duygu Aykin, 600 Northern Way, Winter Springs, Florida came forward. A brief discussion ensued regarding the <br />ownership of the two (2) lots. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address CU 21-18, Ms. Divita made a motion that the Planning and <br />Zoning Commission approve CU 21-18 based upon the staff report and the testimony and evidence presented, <br />including the ten (10) conditions of approval and Attachments A — C. Mr. Bowman seconded the motion. The motion <br />passed unanimously by voice vote. <br />Sixth Item of Business: LPA 21-01: Comprehensive Plan Text Amendment. A proposed amendment to the <br />City of Casselberry Comprehensive Plan to add a Property Rights Element pursuant to Florida Statutes. <br />Ms. Christina Hyson, Planner II, reviewed the information provided in her memorandum dated October 13, <br />2021 to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said staff recommends the Planning <br />and Zoning Commission provide a favorable recommendation to the City Commission for LPA 21-01 to add Section <br />11 Property Rights Element into the City's Comprehensive Plan. <br />
