City Casselberry-ACi Supplemental Agreement #3 -City Center -Concord Village Development Agreement <br />01-09-13 <br />Exhibit A <br />Description & Scope of ACi Work Tasks/Delverables <br />Supplemental Agreement #3 <br />This contract is a Lump Sum contract amount. <br />1.0 Draft Development Agreement Assistance <br />ACi will assist City Staff and City Attorney in the vetting, negotiating and drafting of the content for the <br />Development Agreement. It is anticipated there will be two (2) separate and distinct Development <br />Agreements respectively as follows: <br />Developer Agreement 1-Commercial/Retail Development Agreement <br />Developer Agreement 2 -Residential Development Agreement <br />Areas of focus for ACi will be as follows: <br />a. strategic capture of key commitments made in each developer's offer <br />b. development areawide roles/responsibilities for public areas vs. private areas <br />c. public and private performance measures <br />d. milestone dates for key events <br />e. cross -access easements, stormwater/utility access easements <br />f. street/transportation improvements <br />g. maintenance <br />h. special events coordination <br />L assisting City Staff/Attorney in preparing City required procedural changes to be described <br />referenced in Dev Agreement to enable private sector development (overlay district, code <br />writing, parking study, comprehensive plan consistency review & design criteria) <br />j. attending and assisting City with a reasonable amount of preparation for meetings, <br />attending meetings, and making presentations to City, CRA and Seminole County (meeting <br />frequency/quantities to be mutually agreed to by City-ACi. <br />2. Overlay District Mapping/Prescriptive & Performance Definition <br />ACi will support City staff/City Attorney in creating a new Overlay District that will be superimposed over <br />City's current zoning. It will consist of a physical area with mapped boundaries and written text spelling <br />out requirements that will either be added to, or in place of, those in the current underlying regulations. <br />The new district is intended to be used as a stand-alone area specifically for the proposed development. <br />Tasks will include the following: <br />1. General review of underlying regulations. <br />2. Strategically mapping the physical boundaries with key considerations that capture high <br />economic development value for the City while respecting City's community vision. <br />3. Assisting City Staff/City Attorney with written text (prescriptive/performance) including but not <br />limited to those provisions that address and provide flexibility for immediate and future <br />development for a mix of uses including density limitations, building bulk, scale and setbacks, <br />materials, design standards, buffering, parking, cross -access agreements, utilities, stormwater, <br />landscape, and lighting. <br />4. ACi will review existing and proposed provisions with the private sector development partners, <br />to better understand their perspectives on issues of costs and constructability. <br />2 <br />
