Jose Agostini, 100 Reflections Cir., representative for the property stated they did not know about the <br />hearing in June. Mr, Agostini advised he was asking for an extension, there were other violations, and <br />everything took longer than they thought and to get a clear understanding of what was needed. <br />The Special Magistrate advised that in addition to Supervisor Campbell's testimony, she also had affidavit <br />of non-compliance from Officer Acevedo, indicating the property was not in compliance. Based upon <br />testimony and the affidavit, it was found that the property located at 100 Reflections Cir. was not in <br />compliance and a fine of $200 per day should be imposed as of June 17, 2021. <br />SUBSEQUENT CASE <br />CE -21-000015 400 Misty Oaks Run <br />• No building permit, City Code 1-4.3 <br />Supervisor Campbell advised that this property was non -complaint with a fine running of $ 100 per day. <br />Officer McDonald, advised that in speaking with the Community Development planner, they are waiting <br />on engineered plans and the application fee for conditional use had been paid but plans not submitted. <br />Robert Carson Green, 400 Misty Oaks Run, advised that the process has not been as fast as he would have <br />liked. Mr. Green had a set of drawings picked up on September 16, 2021, not signed and sealed, the property <br />survey was also wrong. Mr. Green continued. <br />Discussion. <br />The Special Magistrate made a finding that CE -21-000015 located at 400 Misty Oaks Run be tabled until <br />the November 18, 2021, hearing. <br />CE -21-000320 493 SR 436. Violation <br />• City Code 1-4.3.a, No building permit <br />• City code 4-18.2.0 Minor modifications of site plans <br />• City Code 3-10.3.c.1 Overgrowth, weeds <br />• City code 46-37 Development permit required. <br />Officer Acevedo gave testimony that the property was reinspected and found to remain in violation on <br />September 13, 2021. The City requested a correction date of October 31, 2021. If no compliance by October <br />31, 2021, then a fine of $200.00 per day should then be imposed for each day of non-compliance thereafter. <br />The City requests a subsequent hearing date of 11/18/2021 to determine compliance. <br />Vincent Wolle, PAW Holdings, 108 Commerce St., Lake Mary gave testimony and advised that he did <br />remove a half wall under a drop ceiling grid and was not aware a permit was required for seal coating the <br />parking lot. Mr. Wolle continued. <br />The Special Magistrate made a finding that CE -21-000320, located at 493 SR 436, was in violation of the <br />City Code Sections as listed on the notice of code violation, based on testimony and evidence provided by <br />the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by 1:00 P.M. <br />November 16, 2021. If there is no compliance by November 16, 2021, then a fine of $200.00 per day will <br />be imposed for each day the property remains in non-compliance. A subsequent hearing will be held on <br />November 18, 2021, to determine if compliance has been achieved. <br />NEW CASE <br />
