Ms. Divita made a motion that the Planning and <br />Zoning Commission approve case number CU 21-13 based on staffs conditions and recommendations, conditions <br />one (1) through eight (8), and Attachment A. Mr. Bowman seconded the motion. The motion passed unanimously by <br />voice vote. <br />Tenth Item of Business: CU 21-14: 1015 SR 436 #109. A conditional use request for the sale of beer and wine <br />for on-site consumption (2COP) in the CG (Commercial General) zoning district. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated July 14, <br />2021 to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff recommends that <br />case number CU 21-14 be approved with staffs conditions, based upon the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations <br />and is consistent with the Comprehensive Plan as per the written findings contained within the staff report. The <br />conditions of approval are as follows: <br />1. The conditional use shall be limited to the location of 1015 State Road 436 #109. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors or confined to outdoor <br />seating areas that have been approved as part of the official site plan. <br />3. Package sales of alcoholic beverages for off-site consumption shall be permitted in accordance with the <br />most current local, state, and federal regulations and only as long as the applicant complies with those <br />same regulations. <br />4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10-2 <br />of the City of Casselberry's Code of Ordinances. <br />6. The business shall remain in compliance with all City, County, and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />8. The conditional use shall commence within 180 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A general discussion ensued regarding outside seating. <br />Mr. Phillips asked the applicant to come forward. Mr. Alexander Diaz, Ms. Lori McDowell, and Ms. Deborah <br />McDowell, 1015 SR 436, Casselberry, Florida came forward. The applicant stated that they did put a table outside <br />due to Covid. She said she does not foresee outside seating for the restaurant. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />
