Mr. Bakalla seconded the motion. <br />The motion passed unanimously by voice vote. <br />Eighth Item of Business: CU 21.11: 2050 SR 436 Unit #116. A conditional use request to allow the sale of beer <br />and wine (2COP) for onsite consumption at Catered Delight. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated June 9, <br />2021, to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff recommends that <br />case number CU 21-11 be approved with staffs conditions, based upon the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations <br />and is consistent with the Comprehensive Plan as per the written findings contained within the staff report. Mr. <br />Jordan -Madden reviewed the following conditions of approval: <br />1. The conditional use shall be limited to the location of 2050 State Road 436 #116. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors or confined to outdoor <br />seating areas that have been approved as part of the official site plan. <br />3. Package sales of alcoholic beverages for off-site consumption shall be permitted in accordance with the <br />most current local, state, and federal regulations and only as long as the applicant complies with those <br />same regulations. <br />4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10- <br />2 of the City of Casselberry's Code of Ordinances. <br />6. The business shall remain in compliance with all City, County, and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />8. The conditional use shall commence within 180 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Phillips asked the applicant to come forward. Mr. Nicholas Allman, 2050 SR 436, Casselberry, Florida <br />came forward. There were no questions for the applicant. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address CU 21-11. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve case number CU 21-11 for the conditional use 2COP license at 2050 SR 436, Suite 116, <br />
