Mr. Bakalla seconded the motion. The motion passed unanimously by voice vote. Eighth Item of Business: CU 21.11: 2050 SR 436 Unit #116. A conditional use request to allow the sale of beer and wine (2COP) for onsite consumption at Catered Delight. Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated June 9, 2021, to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff recommends that case number CU 21-11 be approved with staffs conditions, based upon the staff report and the testimony and evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the written findings contained within the staff report. Mr. Jordan -Madden reviewed the following conditions of approval: 1. The conditional use shall be limited to the location of 2050 State Road 436 #116. 2. All sales and consumption of alcoholic beverages shall be on-site and indoors or confined to outdoor seating areas that have been approved as part of the official site plan. 3. Package sales of alcoholic beverages for off-site consumption shall be permitted in accordance with the most current local, state, and federal regulations and only as long as the applicant complies with those same regulations. 4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. 5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10- 2 of the City of Casselberry's Code of Ordinances. 6. The business shall remain in compliance with all City, County, and State requirements. 7. There shall be no outside display or storage of goods, materials, services, or vehicles. 8. The conditional use shall commence within 180 days of the approval. 9. The conditional use shall expire if the use is discontinued for more than 90 days. 10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. Mr. Phillips asked the applicant to come forward. Mr. Nicholas Allman, 2050 SR 436, Casselberry, Florida came forward. There were no questions for the applicant. Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Phillips asked for a motion to address CU 21-11. Mr. Hale made a motion that the Planning and Zoning Commission approve case number CU 21-11 for the conditional use 2COP license at 2050 SR 436, Suite 116,
