Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />March 10, 2021 <br />Page 2 <br />Emergency Vet Clinic and directed her to speak to Dr. Kelly Brock regarding her concerns about the development of this <br />property. He also disclosed that he would recuse himself from voting on ZB 20-06 — Rezoning of 380 State Road 436 and <br />any future cases for this property. He based his recusal on Florida Statute 286.012 for potential bias due to the fact that the <br />property is adjacent to his community association. <br />In response to the Commission's question, Ms. Borkert explained that Mr. Bakalla's recusal does not require an <br />economic gain or loss. <br />Fifth Item of Business: ZB 20-06 Rezoning of 380 SR 436 and Parcel ID: 17-21.30-300-025N-0000. A request to <br />amend the Official Zoning Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium Rise) for <br />two (2) parcels generally located near the intersection of State Road 436 and Lamplite Way. <br />Ms. Christina Hyson, Planner II, reviewed the information provided in her memorandum dated March 10, 2021 to <br />the City of Casselberry Planning and Zoning Commission. <br />Ms. Divita arrived at the meeting at 6:37 p.m. In response to Mr. Phillip's question, Ms. Divita stated she had read <br />the staff report. In response to Ms. Borkert's question, Ms. Divita stated she had no Ex Parte Communication for any items <br />on the agenda. <br />Ms. Hyson said staff recommends that the Planning and Zoning Commission recommend approval of case number <br />ZB 20-06 to the City Commission, based on the staff report and the testimony and evidence presented, that the request <br />meets the applicable provisions of the Unified Land Development Regulations, and is consistent with the Comprehensive <br />Plan as per the written findings contained in the staff report. <br />A general discussion ensued regarding the proposed project's consistency with the purpose and intent of the <br />Oxford Park Overlay District and the Major Thoroughfare Mixed -Use (MTMU) future land use designation. In response to <br />the Commission's question, Ms. Hyson explained that the PMX-MID (Planned -Mixed -Use: Medium Rise) zoning designation <br />allows for a maximum height of six (6) stories and the applicant is requesting the maximum height for this development. In <br />response to the Commission's question, Ms. Hyson said that the concept plan may change slightly during the site plan <br />review process. She explained that the concept plan is a general concept of what is being proposed for the site and that is <br />what dictated all the size and dimension criteria that are outlined in the PUD (Planned Unit Development) Agreement. Ms. <br />Hyson explained that Table 2-5.4 provides maximum/minimum requirements; however, a PUD intends to provide some <br />flexibility to those requirements.
