Chapter 94 - WATERWAYS <br />Sec. 94-1. - Definitions. <br />The definitions in Fla. Stat. 327.02, as are applicable to the interpretation and <br />enforcement of this Article. are hereby incorporated and made part of this <br />Article. The following additional words, terms and phrases, �.�� for <br />purposes of this Chapter only, shall have the meanings ascribed to them in <br />this Section, except where the context clearly indicates a different meaning: <br />Aquaplane means a board for riding on water, pulled b a <br />Boat means motorboat and vessel and is synonymous with boat as referenced <br />in Section 1(b), Article VII of the State Constitution and includes every <br />description of water craft, barge and air boat, other than a seaplane on the <br />water, used or capable of being used as a means of transportation on water. <br />Canal means an navigable excavation, channel, trench, or artificial diteh or <br />receptacle for the confining and transmission of water and the passage of <br />boats, located wholly or partly within the City. A non -navigable ditch is not a <br />Canal. <br />Derelict means any vessel and/or boat trailer which is in a state of evident <br />disuse, neglect or abandonment; is wrecked or partially dismantled having no <br />motor, engine, or other major parts necessary for operation; has vegetation <br />underneath as high as the body or frame; has refuse or debris collected <br />underneath; is being used solely for storage purposes; does not have all tires <br />of the boat trailer inflated; does not display a current valid license tag on the <br />boat trailer; or which threatens or endangers public health, safety and <br />welfare. <br />Dock means a dock, boat davit, hoist, boat lift, mooring pile or similar <br />structure attached to land permanently to which a vessel can be moored <br />Floating Structure means a floating entity, with or without accommodations <br />built thereon, which is not primarily used as a means of transportation on <br />water, but which serves purposes or provides services typically associated <br />with a structure or other improvement to real property. The term includes <br />but is not limited to, an entity used as a residence place of business, a hotel. <br />a restaurant, etc. Floating Structures do _ not include "boats" or <br />"docks/mooring structures." <br />Inboard motorboat means any boat ,A,hieh is propelled by an), stational=y or <br />built in meehanical dev aPower. <br />Lake means any historically natural single continuous body of water with a <br />water surface area of one acre or more as shown on the City N2837.5 - <br />W8115/7.5 quadrangle map of the U.S. Geological Survey, or other <br />
