<br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA,
<br />AMENDING PART II, CODE OF ORDINANCES, CHAPTER 2,
<br />ADMINISTRATION, ARTICLE IV, BOARDS, COMMITTEES, AND
<br />COMMISSIONS, DIVISION 2, CODE ENFORCEMENT BOARD,
<br />SECTION 2-158, APPLICATION FOR SATISFACTION OR RELEASE OF
<br />CODE ENFORCEMENT LIENS, TO MODIFY PROCEDURES FOR THE
<br />REDUCTION, SATISFACTION, AND RELEASE OF CODE
<br />ENFORCEMENT LIENS; PROVIDING FOR CODIFICATION,
<br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE.
<br />WHEREAS, the City of Casselberry ("City") is granted the authority, under Section 2(b),
<br />Article VIII, of the State Constitution, to exercise any power for municipal purposes, except when
<br />expressly prohibited by law; and
<br />WHEREAS, the Code of Ordinances of the City of Casselberry, Florida, ("Code")
<br />contains provisions allowing for Code compliance violators to apply for forgiveness or reduction
<br />of an existing code enforcement lien; and
<br />WHEREAS, it is in the best interests of the citizens and businesses for the City to continue
<br />to consider code enforcement liens reduction and release requests to encourage compliance; and
<br />WHEREAS, the City desires to amend its procedure for handling the reduction,
<br />satisfaction, and release of code enforcement liens in order to streamline the process and establish
<br />additional detailed objective criteria for considering applications for the reduction, satisfaction,
<br />and release of such liens; and
<br />WHEREAS, words with underlined type shall constitute additions to the original text and
<br />strike thfough type shall constitute deletions to the original text, and asterisks (* * *) indicate that
<br />text shall remain unchanged from the language existing prior to adoption of this Ordinance; and
<br />WHEREAS, the City Commission of the City of Casselberry, hereby finds this Ordinance
<br />to be in the best interest of the citizens of Casselberry's public health, safety, and welfare.
<br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
<br />SECTION I. LEGISLATIVE FINDINGS. The above recitals are hereby adopted as the
<br />legislative findings of the City Commission. The City Commission finds and determines that there
<br />is competent substantial evidence to support the findings and determinations made in this Section.
<br />SECTION II. AMENDMENT OF SECTION 2-158 OF THE CITY CODE OF
<br />ORDINANCES. Section 2-158 of the Code of Ordinances of the City of Casselberry, Florida, is
<br />hereby amended to read, as follows:
