Book 10061 Page 1984 <br />Instrument# 2021131596 <br />WHEREAS, Grantor also requests permission to remove exotic or invasive plant <br />species located within the Conservation Easement; and <br />WHEREAS, District has agreed to amend the Conservation Easement to allow a <br />thirty-foot corridor for the repair and maintenance of the Underground Water Main with the <br />requirement that Grantor restore such property to its now -existing condition, subject to the <br />terms and conditions hereof; and <br />NOW, THEREFORE, in consideration of the above, and the mutual covenants, <br />terms, conditions and restrictions contained herein, and other valuable consideration, <br />the receipt and sufficiency of which is hereby acknowledged, the parties agree as <br />follows: <br />1. Paragraph 2(c) of the Conservation Easement shall be deleted in its entirety <br />and the following new sentence shall be added in its place: <br />(c) Removing or destroying trees, shrubs, or other vegetation, except for <br />removal of noxious, nuisance or exotic invasive plant species as listed on <br />the Florida Exotic Pest Plant Council's List of Invasive Species. <br />2. , Paragraph 3 of the Conservation' Easement shall be deleted in its entirety <br />and the following paragraph shall be added in its place: <br />Grantor reserves unto itself, and its successors and assigns, all rights <br />accruing from its ownership of the Property, including the right to engage in or <br />permit or invite others to engage in all uses of the Property, that are not <br />expressly prohibited herein and are not inconsistent with the purpose of this <br />Conservation Easement. Without limiting the generality of the foregoing, the <br />following activity will be considered reserved rights within the parameters <br />stated below: <br />(a) Construction, installation,, or abandonment of sub -surface utility <br />forcemains by directional drill provided that all work occurs within the <br />thirty (30) foot corridor as identified on the attached "Exhibit A", and all <br />N <br />
