Book 10061 Page 1984 Instrument# 2021131596 WHEREAS, Grantor also requests permission to remove exotic or invasive plant species located within the Conservation Easement; and WHEREAS, District has agreed to amend the Conservation Easement to allow a thirty-foot corridor for the repair and maintenance of the Underground Water Main with the requirement that Grantor restore such property to its now -existing condition, subject to the terms and conditions hereof; and NOW, THEREFORE, in consideration of the above, and the mutual covenants, terms, conditions and restrictions contained herein, and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Paragraph 2(c) of the Conservation Easement shall be deleted in its entirety and the following new sentence shall be added in its place: (c) Removing or destroying trees, shrubs, or other vegetation, except for removal of noxious, nuisance or exotic invasive plant species as listed on the Florida Exotic Pest Plant Council's List of Invasive Species. 2. , Paragraph 3 of the Conservation' Easement shall be deleted in its entirety and the following paragraph shall be added in its place: Grantor reserves unto itself, and its successors and assigns, all rights accruing from its ownership of the Property, including the right to engage in or permit or invite others to engage in all uses of the Property, that are not expressly prohibited herein and are not inconsistent with the purpose of this Conservation Easement.
