Trees on non-residential property that pose an immediate danger to persons or <br />property are not included in the exemption provided in Fla. Stat. 163.045, but do not <br />require permits to remove. <br />SECTION III. Part III, Unified Land Development Regulations, Chapter III, <br />Performance Criteria, Article XIV, Tree Protection, Section 3-14.8, Violations, waivers, and <br />appeals, of the Code of Ordinances of the City of Casselberry, Florida, is amended as follows: <br />Section 3-14.8. — Violations, waivers, and appeals. <br />A. Trees which have been removed without a permit, without documentation pursuant to Section <br />3-14.3, mor which have been intentionally damaged or destroyed by the property owner or <br />related party shall be replaced and afl associated fines shall be paid in accordance with Fla. Stat. <br />162. or the table below: <br />SECTION IV. Codification. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become <br />and be made a part of the Code of Ordinances of the City of Casselberry, Florida; that the <br />Sections of this Ordinance may be renumbered or re -lettered to accomplish such intention; that <br />the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. <br />SECTION V. Conflicts. All Ordinances or Resolutions, or parts of Ordinances or <br />Resolutions in conflict with any of the provisions of this Ordinance are hereby repealed to the <br />extent of the conflict. <br />SECTION VL Severability. If any Section or portion of a Section of this Ordinance <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION VII.
