RESOLUTION 21-3250 <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />WRITTEN TERMINATION OF THE LIBRARY SYSTEM <br />IMPACT FEE INTERLOCAL AGREEMENT SEMINOLE <br />COUNTY/CITY OF CASSELBERRY; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the City of Casselberry (City) and Seminole County (County) provide <br />public services for residents and ensures that there is clear definition for the operations and <br />maintenance of those services; and <br />WHEREAS, the City and County entered into the Library System Impact Fee Interlocal <br />Agreement Seminole County/City of Casselberry (Interlocal Agreement), effective on July 10, <br />1991, with a First Amendment to that document, and adoption of Resolution 674, effective on <br />April 15, 1992; and <br />WHEREAS, the Seminole County Public Library Central Branch facility is located at <br />215 N. Oxford Road, within the city limits of Casselberry that provides public library services to <br />residents throughout the County; <br />WHEREAS, Seminole County adopted the new Library Impact Fee Ordinance 2021-28, <br />anu uic wuuty notiiieu use City trim riv act -on is reCiuireu Ori the City's pari, except to reser <br />permits to the County for impact fee review; and <br />WHEREAS, in keeping with Seminole County Ordinance 2021-28 impact fee review <br />process, a Interlocal Agreement written notice of termination needs to be executed to be <br />consistent with this new process; and <br />WHEREAS, the Interlocal Agreement written termination condition states that, "the <br />Agreement shall be automatically renewed for additional one-year terms commencing October 1 <br />of each year and terminating September 30th of the succeeding year, unless one party delivers a <br />written notice of termination to the other party prior to August 1 of each year." <br />WHEREAS, the City Commission of the City of Casselberry, Florida, has determined <br />that adoption of the amended Seminole County Library Impact Fee Ordinance creates an <br />inconsistent process to the Library System Impact Fee Interlocal Agreement Seminole <br />County/City of Casselberry and the new process results in the need to execute the written notice <br />of termination listed in the Interlocal Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
