§ 34.38(C) (1) (2) Burglar Alarm Service Fees. <br />There shall be a service fee charged for false alarms or <br />systems tests conducted without prior notice to the City as <br />follows: <br />(1) No fee shall be assessed for any of the first <br />three false alarms at the same premises <br />during any consecutive 6 -month period. The <br />fourth false burglar alarm and all subsequent <br />false burglar alarms thereafter shall be <br />assessed a service fee of $100 each. <br />(2) The fee shall be billed to the owner, lessee, <br />or manager of the premises, whichever shall <br />be in residence on the premises. An alarm <br />will be considered valid only if it is the result <br />of a reported crime. <br />SECTION III. CODIFICATION. It is the intention of the City Commission <br />of the City of Casselberry, Florida, and it is hereby ordained that the provisions of <br />this Ordinance shall become and be made a part of the Code of Ordinances of the City <br />of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or <br />relettered to accomplish such intention; that the word, "Ordinance," may be changed <br />to "Section," "Article," or other appropriate word. <br />SECTION IV. CONFLICTS. If any provision of this Ordinance <br />conflicts with other Ordinances or regulations, the more stringent limitation or <br />requirement shall govern or prevail to the extent of the conflict. All Ordinances or <br />parts of Ordinances in conflict with any of the provisions of this Ordinance are <br />hereby repealed. <br />SECTION V. SEVERABILITY. If any Section or portion of a Section of <br />this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be <br />4 <br />
