premises during any consecutive six (6) <br />month period. The fourth (4th) false <br />burglar alarm and all subsequent false <br />burgla alarms shall be assessed a <br />service fee of One Hundred Dollars <br />($100.00) each. <br />(2) The fee shall be billed to the owner, <br />lessee or manager of the premises; <br />whichever shall be in residence on the <br />premises. An alarm will be considered <br />valid only if it is the result of a reported <br />crime. <br />(d) Upon failure of the owner or lessee or manager of the <br />premises to pay the fee specified in this Section within <br />thirty (30) days following receipt of the statement, the <br />unpaid fee may be assessed as a lien upon the real <br />property where the burglar security alarm system is <br />installed, pursuant to Article III, Section 7, of the City <br />Charter and F.S. §166.021. <br />The City may enforce its lien and maintain a personal <br />action against the property owner, lessee and tenant at <br />Lf e same time to recover the unpaid fee and any <br />interest accrued thereon. In any action brought by the <br />City for the collection of the unpaid fee or lien; the City <br />shall be entitled to recover its actual costs. and <br />attorney's fees and costs shall also attach as a lien <br />against the property. <br />SECTION 3. CODIFICATION. It is the intention of the City Commission of the City <br />of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance <br />shall become and be made a part of the Code of Ordinances of the City of Casselberry, <br />Florida; that the Sections of this Ordinance may be renumbered or relettered to accomplish <br />such intention; that the word, "ordinance," may be changed to "section," "article," or other <br />appropriate word. <br />Ordinance No. 01-103-7 <br />Page 3 <br />
