CASSELBERRY CITY COMMISSION <br />Minutes of July 28, 2014 — Regular Meeting <br />Page 8 of 13 <br />Staff Presentation: City Manager Randy Newlon explained that on June 23, 2014 the Commission had <br />approved a contract offer to purchase the former bowling alley property located at 115 Wilshire Boulevard <br />which was contiguous to two City -owned parcels. He added that acquisition of this property would provide a <br />total of approximately five acres for the City to possibly relocate the Police Department to a more strategic <br />location, with the additional possibility of providing a parcel for relocation of the fire station located on Red <br />Bug Lake Road. He stated that the parcel is in the vicinity of several County offices, and the relocation of <br />some of the City's municipal services to that location would benefit the citizens. <br />Mr. Newlon advised that the City's initial offer of $850,000 for the property had been rejected by the Sellers, <br />and a counter-offer of $900,000 was being presented to the Commission for approval. He reminded the <br />Commission that the contract calls for 45 days for the City to perform due diligence examinations and the <br />Commission had already approved funding to pursue those, including building inspection of the bowling alley <br />building and an assessment of its feasibility for conversion to another use; two appraisals; a survey; and an <br />environmental assessment. He added that a report of the due diligence findings would be presented to the <br />Commission at the September 8, 2014 Commission meeting, and if the Commission still desired to move <br />forward, he would ask for approval of a budget amendment to providing funding for the purchase and proceed <br />to a closing on the property. <br />Audience Participation: The following individuals came forward to address Resolution 14-2635: <br />Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to Resolution 14-2635, stating he <br />did not believe the City should purchase land that was not needed, and the Commission <br />should invest in the community by providing road paving, sidewalks and street lighting and <br />should not waste the taxpayers' money on speculative land purchases. <br />During Mr. Fraleigh's comments, Mayor Glancy advised him to stay on point and to follow parliamentary <br />procedures. Mr. Fraleigh stated that he had a constitutional right to freedom of speech and he felt the Mayor <br />did not follow parliamentary procedure and was harassing him by interrupting him during his comments. <br />Commissioner Fry asked for clarification from the Mayor as to which specific parliamentary procedure was <br />violated by Mr. Fraleigh. Mayor Glancy stated that Mr. Fraleigh had gone off point for this agenda item during <br />his comments, and he was asked to be seated. Mr. Fraleigh insisted that he still had time remaining for his <br />comments, at which time Mayor Glancy advised him his time was up and again instructed him to be seated. <br />Mr. Fraleigh complied with Mayor Glancy's request and was seated. <br />Commissioner Fry called for a Point of Order and again asked for clarification as to what rule of parliamentary <br />procedure Mr. Fraleigh had violated and why he was asked to sit down. Mayor Glancy responded that Mr. <br />Fraleigh had gone off point several times during his comments. Commissioner Fry again asked for clarification <br />about what violation of procedure Mr. Fraleigh had committed and how Mayor Glancy felt he had gone off <br />point. Mayor Glancy stated that the meeting needed to move on; however Commissioner Fry disagreed and <br />again requested clarification about why Mr. Fraleigh was asked to be seated. <br />City Attorney Reischmann explained that the Mayor had authority to require a speaker to stay to the issues that <br />are of community City-wide interest, but that the Commission had also adopted rules stating that "Conduct <br />contrary to the normal presentation of business during a Commission meeting which disturbs or interrupts the <br />orderly process of the proceeding is a disturbance. No speaker shall make any slanderous or profane remark <br />which disturbs, disrupts or otherwise impedes the orderly conduct of any Commission meeting." <br />
