CASSELBERRY CITY COMMISSION <br />Minutes of April 14, 2014— Regular Meeting <br />Page 15 of 19 <br />Motion died due to lack of a second. <br />MOTION: Vice Mayor Hufford moved to reduce the lien in Case Numbers CE -13-00570 <br />and CE -12-02047 to $593.74, to be paid within 60 days or the lien amount will <br />revert back to the original amount. Motion was seconded by Commissioner <br />Aramendia. <br />AMENDED MOTION: Vice Mayor Hufford moved to reduce the lien in Case Number <br />CE -13-00570 to $593.75, as recommended by the Code <br />Enforcement Special Magistrate, within 60 days or the lien <br />amount will revert to the original amount. Motion was <br />seconded by Commissioner Aramendia. Motion passed 3-2 by <br />voice vote, Commissioner Fry and Mayor Glancy dissenting. <br />C. Request to Pursue Foreclosure Action — 9 Carriage Hill Circle <br />Staff Presentation: Community Development Director Sandra Smith advised that this item was a request to <br />pursue foreclosure action on property located at 9 Carriage Hill Circle. She gave a brief overview of the issues <br />leading up to the request, explaining that two violations had been found in October of 2012, involving roof <br />maintenance and an accessory structure that was in disrepair. She stated that the cases were heard by the Code <br />Enforcement Board in March of 2013 and an order was issued to bring the property into compliance. She <br />added that a subsequent hearing was held before the Code Enforcement Board in June of 2013, and which time <br />it was determined that the property was still in violation and an Order was imposed setting fines which would <br />accrue at $50 per day per violation. <br />Ms. Smith advised that the violation still continues, the property is vacant, and the property is not <br />homesteaded; therefore, staff brought the case before the Code Enforcement Special Magistrate on March 13, <br />2014 requesting entry of an order to pursue foreclosure on the property. Ms. Smith advised that Florida <br />Statutes Section 162.093 provides that "after three months from the filing of any such lien which remains <br />unpaid the enforcement board may authorize the local governing body attorney to foreclose on the lien or to <br />sue to recover a money judgment for the amount of the lien plus accrued interest". She then stated that staff <br />was requesting support of the Special Magistrate's order to request pursuit of a foreclosure action. <br />Mayor Glancy noted for the record that the property owner was not present at the meeting. <br />Budget Impact: The Attorney cost to pursue foreclosure is not yet known. Attorney fees related to this item <br />will have to be transferred from the Community Development Department through a budget amendment to the <br />Administration Department/Legal Division City Attorney account #001-0140-514.31-01 once costs are known. <br />Recommendation: The City Manager and Community Development Director recommended consideration of <br />the Code Enforcement Special Magistrate's order that foreclosure action be pursued for 9 Carriage Hill Circle, <br />Cases CE -12-020035 and CE -12-02047. <br />MOTION: Commissioner Solomon moved that the City Commission support the request to <br />pursue foreclosure action on property located at 9 Carriage Hill Circle, as <br />
