paving, curbs, gutters, signage, lighting, landscaping, walls, fences, underground piping, underground <br />structures, duct banks, transformers, poles, retention areas, pavers, electric, cable and other utility facilities <br />within the Easement Area; provided that, in no event, shall any of the rights herein reserved to Grantor <br />impede the Easement herein granted or the exercise of the rights of use thereunder. <br />After completion of any repair, maintenance or replacement of any of the Facilities, GRANTEE <br />shall, at its sole cost and expense and in a safe, good and workmanlike manner, remove any temporary <br />improvements and equipment GRANTEE placed on the Easement Area, and restore both the ground surface <br />of the Easement Area and any pavement, grass, irrigation lines and equipment, utility lines, landscaping <br />and other improvements placed thereon in accordance with this Easement, to the original contour, grade <br />and condition which existed immediately prior to the commencement of any such work. In connection with <br />any such work and restoration, GRANTEE shall use commercially reasonable efforts to minimize <br />interference of such work and restoration with the use of the Easement Area by GRANTOR, its successors <br />and assigns for the purposes stated herein. In addition, GRANTEE shall cause any lien filed against the <br />Easement Area for any labor or materials in connection with any work of any character performed or <br />claimed to have been performed on the Easement Area at the direction or sufferance of GRANTEE or its <br />assigns to be promptly released or bonded off. If any such lien against the Easement Area is not promptly <br />released or bonded off, GRANTOR shall have the right (but not the obligation) to cause such lien to be <br />released. GRANTEE shall pay on demand all of GRANTOR'S reasonable costs in connection therewith. <br />All covenants, terms, provisions and conditions herein contained shall run with the land and shall <br />inure to and be binding upon the heirs and/or legal representatives, successors and assigns of the parties <br />hereto, respectively. <br />[Signature pages follotia] <br />ACCESS EASEMENT <br />4838-8800-2757. v. 4 <br />
