GRANT MALOY, SEMINOLE COUNTY <br />CLERK OF CIRCUIT COURT & COMPTROLLER <br />CFN# 2021057698 Bk:9918 Page: 1699-1708(10Pgs) <br />REC: 05/04/2021 8:03:16 AM by hdevore <br />RECORDING FEES $86.50 <br />DEED TAX $0.70 <br />This instrument prepared by <br />and after recording, return to: <br />Gardner Savage <br />Scheef & Stone, L.L.P. <br />500 North Akard Street, Suite 2700 <br />Dallas, Texas 75201 <br />This instrument is being recorded to further memorialize and confinn the dedication of Forcemain and <br />Access Easement dedicated to South Seminole and North Orange County Wastewater Transmission <br />Authority and the City of Casselberry in that certain plat of.lefferson Lake Howell recorded in Plat Book 84, <br />Page 67, ofthe Official Records of Seminole County, Florida and is being made for nominal consideration. <br />A portion of Lot 1, Section 21 & Section 22, Township 21 South, Range 30 East, Seminole County, Florida. <br />FORCEMAIN AND ACCESS EASEMENT <br />THIS FORCEMAiN AND ACCESS EASEMENT (this "Easement") is made and entered into this <br />L day ofX�2/�021, by and among JEFFERSON LAKE HOWELL, LLC, a Delaware limited <br />liability company, wx1se by <br />is 1420 Spring Hill Road, Suite 420, McLean, Virginia 22102, <br />hereinafter the GRANTOR, and the SOUTH SEMINOLE AND NORTH ORANGE COUNTY <br />WASTEWATER TRANSMISSION AUTHORITY, created by Florida Senate Bill 1341, whose address is <br />410 Lake Howell Road, Maitland, Florida 32751, and the CITY OF CASSELBERRY, a municipal <br />corporation, whose address is 95 Triplet Lake Drive, Casselberry, Florida 32707, hereinafter, collectively, <br />the GRANTEE. <br />WITNESS ETH, that for and in consideration of the sum of Ten Dollars ($10.00) and other <br />valuable consideration paid to the GRANTOR by the GRANTEE, the receipt whereof is hereby <br />acknowledged, GRANTOR does hereby grant, bargain, sell, convey and warrant to the GRANTEE, its <br />respective successors, agents and assigns, lessees and tenants, a perpetual non-exclusive access and utility <br />easement for vehicular and pedestrian access over and across the Easement Area (hereinafter defined) with <br />full authority to repair, maintain and replace the force main and related and ancillary improvements (the <br />"Facilities") installed within the Easement Area by GRANTOR as the GRANTEE and its assigns may <br />deem necessary. For the purposes of this Easement, "Easement Area" shall mean that certain area labeled <br />"Forcemain and Access Easement Dedicated per Plat" and dedicated to GRANTEE on that certain plat of <br />Jefferson Lake Howell recorded in Plat Book 84, Page 67, of the Official Records of Seminole County, <br />Florida, which area is more specifically described on Exhibit A attached hereto and depicted graphically <br />on Exhibit B attached hereto. <br />TO HA VE AND TO HOLD said Easement unto said GRANTEE and its assigns forever. <br />GRANTOR covenants that it is the owner in fee simple of the Easement Area, that GRANTOR <br />has the right to grant the easement stated herein, and further covenants that the GRANTEE shall have quiet <br />and peaceful possession, use and enjoyment of the rights herein granted. <br />GRANTOR and its successors and assigns agree not to construct or permit others to construct any <br />buildings or other structures within the Easement Area that may interfere with the normal operation or <br />maintenance of the Facilities. GRANTOR reserves all rights not herein granted pursuant to this Easement, <br />including but not limited to, the right of free ingress and egress under, over and upon the Easement Area <br />and to grant further easements under, over and upon the F;asement Area, and the right to maintain asphalt, <br />ACCESS EASEMENT <br />4838-8800-2757, V. 4 <br />
