CASSELBERRY CITY COMMISSION <br />Minutes of January 25, 2021 —Regular Meeting <br />Page 4 of 15 <br />Account Number <br />Increase: <br />001-0000-366.91-03 <br />001-0410-572.56-01 <br />Account Description <br />Amount <br />Private Sources $2,500 <br />Small Tools & Minor Equipment/Memorial Benches $2,500 <br />Recommendation: The City Manager and the Public Works Director recommended approval of Budget <br />Amendment #21-018. <br />Audience Participation: No one came forward to address the Consent Agenda. <br />MOTION: Commissioner Aramendia moved to approve the Consent Agenda, as presented. <br />Motion was seconded by Vice Mayor Busch. Motion carried unanimously by <br />voice vote 5-0. <br />S. DISCUSSION ITEMS <br />A. Future Agenda Items <br />At Mayor Henson's request, City Attorney Reischmann gave an overview of Florida's Sunshine Law and <br />the penalties associated with violation of those restrictions placed on elected officials regarding <br />communications, including exchange of emails with each other, and even prohibitions from private citizens <br />relaying information discussed with one elected official to another elected official. She explained that there <br />were criminal penalties associated with violation of the Sunshine Law, which resulted in elected officials <br />not being able to have the type of dialogue that some citizens would like to have due to the restrictions by <br />which the elected officials were bound under the law. She explained that under the City's Charter the <br />Commission could judge the qualifications of its members and have a hearing as to the behavior of one of <br />its members; however, in order to act properly, the Commission would have to remain impartial, and hear <br />evidence and judge the evidence at a public meeting following the proper process. She stated she hoped <br />this explanation would help with some of the confusion expressed by the public on why there had not been <br />a quick resolution to the issues which had arisen relating to comments made by Vice Mayor Busch. <br />Mayor Henson proposed that a resolution be drafted by the City Attorney stating that the City and the City <br />Commission were opposed to any violence, violent speech, or anything that would incite violence, to be <br />considered at the next City Commission meeting. <br />MOTION: Vice Mayor Busch moved to direct the City Attorney to draft a resolution for <br />City Commission consideration condemning all violence, including all violence <br />associated with the 2021 Presidential election. <br />Mayor Henson clarified he was not looking for a resolution that was specific to any one incident but <br />condemning anything that would incite violence for any reason. City Attorney Reischmann confirmed that <br />would give her enough direction to prepare the resolution. <br />
