Second Reading of Ordinance 20-1542 — Amending the Official Zoning Designation for Properties Located at the Northwest Corner of the Intersection of Seminola Boulevard and Murphy Road (ZB 20-02) The City Clerk read Ordinance 20-1542 by title, as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; AMENDING THE ZONING CLASSIFICATION FROM CS (COMMERCIAL SERVICE) TO CG (COMMERCIAL GENERAL) FOR APPROXIMATELY 2.42 ACRES GENERALLY LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF SEMINOLA BOULEVARD AND MURPHY ROAD, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 20-1542 was advertised in the Orlando Sentinel on Thursday, November 5, 2020. Staff Presentation: Planner 11 Christina Hyson stated that Ordinance 20-1542 amends the official zoning designation for two (2) parcels located at the northwest corner of the intersection of Seminola Boulevard and Murphy Road from CS (Commercial Service) to CG (Commercial General). On August 26, 2020 written notices for the Official Zoning Map amendment were posted on the subject properties and a notification letter was sent to all property owners within 500 feet. The Planning and Zoning Commission, serving as the City's Local Planning Agency (LPA), voted unanimously at its meeting on September 9, 2020 to recommend approval of Ordinance 20-1542 to the City Commission. The request to amend the Official Zoning Map from CS (Commercial Service) to CG (Commercial General) for the subject properties is: consistent with the City's Comprehensive Plan and the Commercial Future Land Use designation; compatible and consistent with the adjacent land uses and zoning districts; and that connections for City water and sanitary sewer services are available to the subject properties. In response to questions from the City Commission about the difference between the Commercial Service (CS) and Commercial General (CG) zoning designations, Ms. Hyson advised that both were consistent with the future land use designation and fairly similar in terms of size and dimension criteria for development; however, there were slight differences in the land uses, as CG was more tailored to general retail and services, whereas CS allowed for more industrial uses and more trade and skilled services. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Community Development Director recommended adoption of Ordinance 20-1542 on second and final reading.
