Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />December 11, 2019 <br />Page 6 <br />Attachment A. Ms. Costello seconded the motion. The motion passed with a majority vote with Mr. Bakalla casting <br />the dissenting vote. <br />Ninth Item of Business: LPA 17-16: Land Use Table (DISCUSSION ONLY). A discussion only item related to <br />proposed changes to Section 2-5.3, Table 2.5.3, Land Use By District, and Section 5-21.2, Definition of <br />Terms. <br />Ms. Emily Hanna, Development Services Manager, reviewed the information provided in her memorandum <br />dated December 11, 2019 to the City of Casselberry Planning and Zoning Commission. Ms. Hanna explained that at <br />the last meeting the Planning and Zoning Commission asked for additional research on the following items: <br />1. Definition of family <br />2. Churches — constructing columbarium regulations <br />3. Differences between Pre -k and preschool <br />Ms. Hanna reviewed staffs proposed changes to the three items and the Planning and Zoning Commission <br />agreed to the changes. <br />In response to the Commission's question regarding regulations for internet cafe/gambling, Ms. Hanna <br />stated that staff would do additional research and provide that information at the next meeting. In response to the <br />Commission's question regarding adding body art establishments to the general retail and service category, Ms. <br />Hanna explained that body art establishment is being removed from the non-traditional use section. She stated there <br />was a court case in 2017 that states that Amendment 1 protects body art establishments. She said that staff can limit <br />the location but the City cannot put this in a category that does not allow free speech to take place. Ms. Hanna said <br />that staff took this change to the City Commission a few years ago and it did not pass. <br />The Planning and Zoning Commission asked for additional research on the following items: <br />1. Internet cafe/gambling <br />2. Drive through establishments/grocery pickup <br />3. Charging stations — service stations/fuel dispensing <br />4. Towing/savage yards <br />There was no one in the audience for audience participation. <br />Ms. Hanna said that industrial uses would be discussed at the January Planning and Zoning Commission <br />meeting. She said staffs goal is to bring an ordinance to the Commission with all the necessary changes in March <br />and have it adopted in May. <br />
