Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />October 9, 2019 <br />Page 2 <br />Fourth Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />Fifth Item of Business: Public Comments. <br />There were no public comments. <br />Sixth Item of Business: CU 19-14: 1001 State Road 434. A conditional use request to operate a daycare facility at 1001 <br />State Road 434. <br />Mr. Jonathan Tardif, Planner I, reviewed the information provided in his memorandum dated October 9, 2019 to the <br />City of Casselberry Planning and Zoning Commission. Mr. Tardif made the following two corrections to his staff report: <br />1. The correct square footage should be 2,600 <br />2. Hazardous Waste - deleting the reference to animal waste <br />Mr. Tardif said staff recommends the Planning and Zoning Commission approve CU 19-14 to operate a daycare <br />facility at 1001 State Road 434. He said staffs recommendation is based on the findings of fact and conclusions of the staff <br />report dated October 9, 2019, and the following conditions: <br />1. The conditional use shall be limited to the location of 1001 State Road 434. <br />2. There shall be no stacking of vehicles for the pick up or drop off of students. Parents must park and walk <br />children in to the business. <br />3. The maximum enrollment cannot exceed 34 children and 3 employees in the facility at a given time without <br />additional conditional use approval, therefore, a minimum of 15 parking spaces must be provided on site. <br />4. The business shall remain in complete compliance with all City, County and State requirements. <br />5. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />6. All applicable licenses and permits shall be obtained prior to the commencement of any business activities at the <br />site. <br />7. The conditional use shall commence within one year of approval. <br />8. A new conditional use application shall be required if the use should cease for more than 90 days. <br />9. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />In response to the Commission's question regarding adequate lighting on the site, Mr. Tardif said he would need to <br />do some additional research to make that determination. In response to the Commission's question, Mr. Tardif said as far as <br />he knows this is the first 24/7 day care facility in the City and there were no limitations in the City Code for a 24-hour business. <br />A brief discussion ensued regarding the outdoor play area and concerns with stacking on Highway 434. <br />Mr. Henson asked the applicant to come forward. Ms. Vivian Alicea, 714 South Edgemon Avenue, Winter Springs, <br />Florida came forward. Ms. Alicea explained that there is a routine to the number of children being dropped off and picked up <br />at specific times and a schedule could be made accordingly.
