Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />September 11, 2019 <br />Page 8 <br />The Commission suggested adding the statement that requires an arborist/landscape professional provide <br />documentation stating that the tree is considered hazardous be added to the ordinance. Mr. Bowley said that the <br />City could leave the Code as it stands today and that would be acceptable. He said the Florida Statutes puts local <br />governments in the position to comply with it and the Florida Statute prevails. <br />Ms. Campbell made a motion to recommend to the City Commission to repel the ordinance. <br />Ms. Costello seconded the motion. After a brief discussion, Ms. Campbell rescinded her motion. <br />After a brief discussion regarding the Commission's options for this item, Mr. Henson asked for a motion to <br />address LPA 19-14. Ms. Phillips made a motion that the Planning and Zoning Commission recommend denial of the <br />proposed ordinance. Ms. Campbell seconded the motion. The motion passed with a majority vote with Mr. Bakalla <br />casting the dissenting vote. <br />Eighth Item of Business: Public Comments. <br />There were no public comments. <br />Ninth Item of Business: Other Business. <br />Mr. Bowley stated that the hotel, motel and transient lodging draft ordinance would be on the October <br />Planning and Zoning Commission agenda.
