She apologized if it sounded as she was attacking the <br />Commission. <br />Sixth Item of Business: SPR 19-07: Legacy Place Townhomes. A request for a major site plan modification to <br />the approved site plan for a 69 -unit townhome community located at the northeast corner of the intersection <br />of Seminola Boulevard and Murphy Road. <br />Mr. Dean Fathelbab, Planner II, reviewed the information provided in his memorandum dated September <br />11, 2019 to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab said staff requests the Planning <br />and Zoning Commission approve the major site plan modification for the Legacy Place Townhomes (SPR 19-07). He <br />said this recommendation is based on the findings of fact and conclusions of the staff report dated September 11, <br />2019, and subject to the five (5) conditions of approval outlined in the staff report. The conditions of approval are: <br />1. The applicant shall complete the proposed plat to subdivide the subject property for the townhome <br />community. <br />2. All remaining Public Works comments shall be addressed prior to the issuance of any site permits and <br />building permits. <br />3. All required local, regional, state, and federal permits shall be obtained before commencement of <br />development. <br />4. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to <br />the expiration of this approval. <br />5. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and <br />void. <br />In response to the Commission's question, Mr. Fathelbab explained that Tract C would be used for a 1 -hole <br />putting green and other amenities. A general discussion ensued regarding the reduction to the number of the parking <br />spaces, parking space size and the square footage of the two (2) and three (3) bedroom units. <br />Mr. Henson asked the applicant to come forward. Mr. Philip Kaprow, 2 South Orange Avenue, Orlando, <br />Florida came forward. Mr. Kaprow said they support staffs recommendations. A brief discussion ensued regarding <br />Tract C use as a recreational open space area. <br />In response to the Commission's question, Mr. Fathelbab explained that the original site plan approval has <br />not expired and it is still valid because there is an active engineering permit for the project <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />
