The applicant was not present. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />A discussion ensued regarding the verbiage needed to modify condition number 5 eliminating the need for <br />the Planning and Zoning Commission's review for a minor modification to the size of the dock. Mr. Henson asked for <br />a motion to address CU 20-04. Mr. Hale made a motion that the Planning and Zoning Commission approve case <br />number CU 20-04 with staffs conditions and finds that based upon the staff report and the testimony and evidence <br />presented, the request meets the applicable provisions of the Land Development Code and is consistent with the <br />Comprehensive Plan as per the written findings contained within the staff report and modifying condition number 5 to <br />read: A new conditional use will be required if the length of the dock is extended further into the waterbody, or if the <br />overall square footage is increased by more than 10%. Ms. Campbell seconded the motion. The motion passed <br />unanimously by voice vote. <br />Seventh Item of Business: SP 16-04: Legacy Place Townhomes — Final Plat. A request to subdivide a single <br />parcel (Parcel ID: 26.20-30-5AR-ODOO.1300) on the corner of Seminola Boulevard and Murphy Road to <br />accommodate the approved site plan for a 64 -unit townhome community. <br />Mr. Dean Fathelbab, Economic Development Planner, reviewed the information provided in his <br />memorandum dated August 12, 2020 to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab <br />explained that the applicant submitted a fifth submittal after the staff report was completed; however, that does not <br />change the conditions of approval listed in the staff report. <br />Mr. Fathelbab requested that the Planning and Zoning Commission recommend approval with staffs <br />conditions for case number SP 16-04, Legacy Place, final plat, to the City Commission and find that based on the <br />staff report and the testimony and evidence presented, the request meets the applicable provisions of the Land <br />Development Code and is consistent with the Comprehensive Plan as per the written findings contained in the staff <br />report. The conditions of approval are as follows: <br />1. The remaining comments from the fourth review, dated July 16, 2020 shall be addressed prior to review <br />and approval by the City Commission. <br />2. The City Surveyor, City Engineer, Community Development Director, City Clerk, and City Mayor shall <br />execute the signature block prior to recording of the plat. <br />
