City of Casselberry I Procurement and Contract Management Division <br />95 Triplet Lake Drive, Casselberry, Florida 32707 <br />Phone: 407-262-7700, Ext. 1142 1 procurements-casselberry.org <br />RFP -2020-0636 COMMERCIAL SOLID WASTE SERVICES AGREEMENT FOR OPEN -TOP <br />ROLL -OFF CONTAINERS FOR NON-PUTRESCIBLE SOLID WASTE <br />18.00 Complaints <br />(a) All complaints shall be addressed within twenty-four (24) hours from the receipt of <br />the complaint by the Franchisee. <br />(b) The Franchisee shall supply the City Director of Public Works with copies of all <br />complaints on a form approved by the City and indicate the disposition of each <br />complaint. Such records shall be available for City inspection at all times during <br />business hours. The form shall indicate the day and hour on which the complaint <br />was received and the day and hour in which it was addressed, the name of the <br />complainant, the nature of the complaint, and the manner of resolution. When a <br />complaint is received on the day preceding a holiday or on a Saturday, it shall be <br />serviced on the next normal working day. Each customer complaint shall be <br />considered legitimate unless satisfactory evidence to the contrary is furnished to the <br />Director of Public Works or designee. <br />19.00 Notification <br />The Franchisee shall notify all customers about complaint procedures, regulations, and <br />days of collection. <br />20.00 Franchise Personnel <br />(a) The Franchisee shall assign a qualified person or persons to be in charge of his/her <br />operations in the City and shall give the name or names to the City, together with <br />information regarding experience. The personnel listed in the RFP are considered <br />key personnel for performing this Agreement. Substitutions for key personnel or <br />substantial reduction in the key personnel must not be made without the prior written <br />consent of the City. <br />(b) Franchisee's collection employees shall wear a clean uniform bearing the <br />Franchisee's name and maintain a disciplined manner while in uniform. <br />(c) Each employee shall, at all times, carry a valid operator's license for the type of <br />vehicle he/she is driving. Vehicle drivers shall not unduly interfere with vehicular or <br />pedestrian traffic, and vehicles shall not be left standing on streets except as made <br />necessary by loading operations and shall move with the traffic flow. <br />(d) The Franchisee shall provide operating and safety training for all personnel and shall <br />certify the same to the City annually upon renewal of this Franchise. Such <br />certification shall include a roster identifying all employees employed in the City, their <br />job descriptions and nature, and type of training given said employees. <br />(e) The Franchisee shall comply with the Equal Employment Opportunity Program, the <br />Fair Labor Standards Act, and all other applicable Federal and State Statutes <br />pertaining to Fair Employment Practices. <br />21.00 Employment and Compliance with Laws <br />Compliance within laws. The right is hereby reserved for the City to adopt, in addition to <br />the provisions herein contained and existing applicable ordinances, such additional <br />regulations as it shall find necessary in the exercise of the police power, provided that <br />such regulations by ordinance or otherwise shall be reasonable and not in conflict with the <br />intended purpose of this Franchise.
