In the event of any spillage, the <br />Franchisee shall immediately clean up any litter or leakage in the entire affected area. <br />11.00 Disposal <br />(a) The Franchisee shall dispose of all non-putrescible trash removed from the City <br />pursuant to the request in conformance with all applicable Federal and State of <br />Florida statutes and State of Florida Department of Environmental Protection <br />regulations. The Franchisee shall furnish all necessary equipment and labor to <br />collect non-putrescible trash as requested from the Commercial establishments in <br />the City. <br />(b) All solid waste for disposal shall be hauled to the Seminole County Landfill or <br />Transfer Station. <br />(c) The Franchisee is not required to, but is encouraged to offer Commercial Recycling <br />services. <br />(d) The City will not be responsible for disposal charges or any recycling fees charged <br />to the Franchisee. The Franchisee is responsible for disposing of all collected waste <br />and recyclables collected in the City in accordance with all State and Federal <br />statutes and regulations and agrees to accept all liability for any remedial activities <br />or fines which may arise from the unlawful disposal of same. <br />12.00 Charges and Rates <br />(a) All charges and rates for the commercial collection of non-putrescible trash in open - <br />top roll -off containers shall be: <br />See Exhibit B - Price Proposal Form <br />(b) The Franchisee shall provide adequate containers, as determined by the Director of <br />Public Works or designee, and solid waste collection, disposal, and recycling <br />services for up to 12 special events sponsored or conducted by the City in each <br />calendar year, at no cost to the City. For any additional special events, the City shall <br />pay the established commercial rates. <br />(c) The Contractor shall have the right to apply rate adjustments for service rates to be <br />effective on the annual anniversary of the services provided under this Contract. <br />Accounts must be notified in writing at least sixty (60) days prior to the anniversary <br />date. Maximum rate increases shall be the lesser of proposed annual increase on <br />Price Proposal Form or on the basis of seventy-five percent (75%) of any increase <br />in the cost of living, not to exceed three percent (3%) annually, as reported in the <br />Consumer Price Index for All Urban Consumers (Water, Sewer, Trash Collection <br />Services) U.S. City average as published by the Bureau of Labor Statistics of the <br />United States Department of Labor (the "index"). The new rates shall be calculated <br />multiplying the existing rates by a fraction, the numerator of which shall be the Index <br />for the month of October prior to the respective anniversary date and the <br />denominator of which shall be the Index for the month of October in the previous <br />year and multiplying this result by 75%. <br />
