18. Legal Services. (To include attorney, paralegals, expert witnesses, <br />interpreters, translation services, mediators, and court reporters. <br />19. Material from publishers and copyright holders. <br />20. Medicaid Services delivered to an eligible Medicaid recipient unless the <br />agency is directed otherwise by law. <br />21. Prevention Services related to mental health, including drug abuse <br />prevention programs, child abuse prevention programs, and shelters for <br />runaways, operated by not-for-profit corporations. <br />22. Professional services. Contracts for professional services involving peculiar <br />skill, ability, experience or expertise, which are in their nature unique and <br />not subject to competitive bidding, or competitive proposals; however, state <br />laws, such as the Consultants' Competitive Negotiation Act, as amended, to <br />the extent applicable, shall be followed. <br />23. Public Notices, except as regulated by Policy, Ordinance and/or Florida <br />Statutes as amended. <br />24. Real Property, except as regulated by Policy, Ordinance and binding Florida <br />law, as amended. <br />25. Security related purchases. <br />26. Services or Commodities exempted by Florida Statutes, as amended. <br />27. Services or Commodities provided by Non -Profit organizations or other <br />governmental entities. <br />28. Payments for goods or services which are Direct Payments as defined in this <br />Policy. <br />29. Sole Source goods or services that are only available through one source. <br />30. Sponsorships. <br />31. Standardized Equipment Annual Maintenance repairs and support costs. <br />32. Utilities. <br />33. Workshop and seminar registration, attendance, training, strategic planning <br />and/or costs of job-related travel. <br />D. Best interest of the City. Purchases and contracts for commodities or services are <br />exempt from competitive selection when the City Commission declares that the <br />process of competitive bidding and/or competitive proposals is not in the best <br />interest of the City. <br />1.2 SEVERABILITY <br />If any section of this Policy, or any application thereof, to any Person or circumstance is held <br />invalid, such invalidity shall not affect other sections or applications of this Policy, which can be <br />given effect without the invalid section or application, and to this end, the sections or applications <br />of this Policy are declared to be severable. <br />1.3 WAIVER OF REQUIREMENTS <br />The City Commission may, when deemed to be in the best interest of the City and not inconsistent <br />with law or City Code, waive any or all requirements or provisions set forth in this Policy and <br />proceed thereafter to take whatever action is deemed to be in the best interest of the City. <br />1.4 CHANGES IN LAWS AND REGULATIONS <br />In the event an applicable law or regulation is modified or eliminated, or a new law or regulation is <br />adopted, the revised law or regulation shall, to the extent inconsistent with this Policy, automatically <br />Page 6 <br />
