and conditions of any Grant, Contract, gift or bequest that is otherwise consistent <br />with law. <br />B. Application to City Procurement. This Policy shall apply to all expenditures of <br />public funds by the City unless otherwise exempted by the Policy or by specific <br />action by the City Commission. <br />C. The following are exempt from the Competitive Solicitation provisions of this <br />Policy, but do not preclude the City from competitive selection, and is not intended <br />to be an exhaustive or exclusive list. The City Manager may determine if a <br />contractual service must be procured through the competitive procurement process <br />if not expressly listed <br />1. Artistic Services. (Defined herein "artistic services" does not include <br />advertising or typesetting.) <br />2. Academic Program reviews. <br />3. Advertisements, except as regulated by State Statute. <br />4. Auditing Services, except as regulated by State Statute. <br />5. Commodities or Services provided or awarded by other governmental <br />agencies including, but not limited to, federal, states, counties, cities, school <br />boards, community colleges, and state university systems. <br />6. Continuing education events or programs that are offered to the general <br />public and for which fees have been collected that pay all expenses <br />associated with the event or program. <br />7. Cooperative Purchases and utilization of other Governmental Agency <br />Contracts. <br />8. Copyrighted materials, including computer software; <br />9. Dues, memberships, and subscriptions. <br />10. Emergency purchases. <br />11. Specialized Recruiting Services. (Defined herein as executive search firms <br />used for the recruitment of management, executive, subject matter experts <br />or highly specialized personnel which shall be recruited with the intent of <br />becoming part of the City's full time/permanent staff. This exemption does <br />not include personnel for temporary employment or staff augmentation <br />needed on a temporary basis.) <br />12. Family Placement Services. <br />13. Financial Services. <br />14. Goods and/or Services given to or accepted by the City via Grant, gift or <br />bequest. <br />15. Medical or Health Services. (To include services mandated through the <br />court system, involving examinations, diagnosis, treatment, prevention, <br />medical consultation, counseling and outside providers administering the <br />program, including but not limited to, substance abuse and mental health <br />Services.) <br />16. Insurance, except as regulated by Ordinance, Resolution or Florida Statutes <br />as amended. <br />17. Lectures by individuals. <br />Page 5 <br />
