3. A member of the City Commission, the City Manager, or a spouse, or child, <br />has an employment relationship or a material or financial interest in the <br />vendor, as defined in the Florida Statutes. <br />4. As otherwise provided pursuant to Florida Statutes. <br />B. No public officer or employee of the City shall solicit anything of value, including <br />a gift, loan, reward, promise of future employment, favor or service. <br />C. In addition to the prohibitions concerning gifts and gratuities as stated in Sections <br />112.313(2) and 112.3148, Florida Statutes and the City Human Resource policies, <br />employees within the Procurement and Contract Management Division shall not <br />accept any gift from a Lobbyist, as that term is defined in Section 1 ] 2.3148(2) (b), <br />Florida Statutes, regardless of the dollar value. City employees should refer to <br />Human Resources Employee Manual relating to regulations regarding gifts. <br />D. It shall be unethical for any payment, gratuity, or offer of employment to be made <br />by, or on behalf of, a potential bidder, contractor, or subcontractor, to any person <br />associated with a particular solicitation or award, as an inducement for the award. <br />All potential bidders, contractors and subcontractors are bound by the Cone of <br />Silence below. <br />E. Any violation of any provision of this section shall subject the violator to the sanctions <br />contained in the Florida Statutes Chapter 112 and any other applicable state or federal <br />law, as well as adverse employment action. <br />2.2 CONE OF SILENCE <br />A. The Cone of Silence is a prohibition on communications relating to a competitive <br />solicitation or advertised solicitation which commences upon the issuance of the <br />solicitation document. <br />B. The Cone of Silence for awards requiring City Commission approval concludes at <br />the beginning of the meeting at which the City Commission will be presented the <br />award(s) for approval or to request authorization to negotiate a contract(s), or when <br />the Commission rejects all bids or responses to the sealed competitive solicitation, <br />or takes other action which ends the sealed competitive solicitation process. <br />However, if the City Commission refers the item back to the City Manager for <br />further review, or otherwise does not take action on the item, the Cone of Silence <br />will be reinstated until such time as the City Commission meets to consider the item <br />for action. <br />D. Bidders, respondents, lobbyists or consultants shall not contact any City employee <br />or City official, including the City Commission, the City Manager, or any member <br />of the Evaluation Committee concerning an active Solicitation during the Cone of <br />Silence Period. All questions and inquiries concerning procedural matters shall be <br />directed to the Procurement and Contract Management Division only. The contact <br />person must not be a member of the selection/evaluation committee or the person <br />designated to negotiate the contract. <br />Page 9 <br />
