SECTION II. ETHICS IN PUBLIC CONTRACTING <br />2.0 STANDARDS OF CONDUCT <br />A. Public employment is a public trust. Public employees must discharge their duties <br />impartially so as to assure fair, competitive access to City procurement by responsible <br />contractors. Employees should conduct themselves in such a manner as to foster <br />public confidence in the integrity of the City's procurement process. <br />B. The Procurement and Contract Management Division adheres and subscribes to the <br />National Institute of Governmental Purchasing, Inc. (NIGP) Code of Ethics and the <br />Florida Association of Public Procurement Officials (FAPPO) as amended. <br />C. Fraudulent Misconduct. All employees of the City, officers, and elected officials <br />under the jurisdiction of the City, and anyone doing business for or with the City, are <br />prohibited from placing City resources at risk through fraudulent misconduct, <br />misappropriation of assets, and fraudulent reporting of information affecting the City. <br />D. Failure of a City employee to adhere to this Policy or the Procurement procedures as <br />established by the City Manager shall subject that employee to disciplinary action up <br />to and including termination. <br />E. Those doing business with the City must observe high standards of honesty and <br />integrity. Any effort to influence any employee to breach standards of ethical conduct <br />is also a breach of ethical standards. <br />2.1 CONFLICT OF INTEREST <br />A. Conflict of Interest. Bidders, members of an Evaluation Committee, awarded <br />Contractors, and City employees shall not engage in any action that would create <br />conflict of interest in the performance of their obligation with the City, or would <br />violate, or cause others to violate, the applicable provisions of the Florida Statutes <br />and federal laws relating to ethics in government. <br />No procurement of goods, services, professional services or construction in which a <br />conflict of interest occurs between the City and the vendor shall be made with any <br />person. A conflict of interest may occur under the following situations: <br />1. Gifts. A person or business entity doing business with the City is prohibited <br />from giving, either directly or indirectly, a gift that has a value in excess of <br />$100 to an employee of the City, City official, or the City's Procurement and <br />Contracts Management Division or any other person on his or her behalf that <br />reasonably tends to influence or reward official conduct; or the person or <br />business entity knows is intended to reward the employee in the discharge of <br />official duties, as outlined in Section 112.3148, Florida Statutes, as amended. <br />2. An employee of the City or an individual chosen by the City to serve as a <br />member of an evaluation committee has a material interest in the vendor as <br />defined in the Florida Statutes. <br />Page 8 <br />
